<![CDATA[Tujuan Penelitian ini adalah untuk menganalisa mengenai alasan penetapan Gisel Anastasia menjadi tersangka dalam kasus penyebaran video pribadi pornografinya sesuai dengan Pasal 4 ayat (1) Undang-Undang Nomor 4 Tahuhn 2008 tentang Pornografi. Hasil dari analisa ditemukan bahwa seharusnya hukuman dibebankan kepada penyebar video tersebut sesuai dengan Pasal 27 ayat (1) Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan atas Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Penulis memakai metode yuridis normatif dari data sekunder dalam mengkaji permasalahan ini. Hasil dari penulisan ini menemukan bahwa lebih tepatnya Gisel menjadi korban penyebaran video pornografi dan tidak dijadikan tersangka karena video tersebut hanya untuk kepentingan pribadi dan tidak memiliki niatan untuk menyebarluaskan kepada masyarakat umum. The purpose of this study is to analyze the reasons for determining Gisel Anastasia as a suspect in the case of distributing her personal pornography videos in accordance with Article 4 paragraph (1) of Law Number 4 of the Year 2008 concerning Pornography. The results of the analysis found that the penalty should be imposed on the video disseminator in accordance with Article 27 paragraph (1) of Law Number 19 of 2016 concerning Amendments to Number 11 of 2008 concerning Electronic Information and Transactions. The author uses the normative juridical method from secondary data in assessing this problem. The results of this writing found that Gisel was more precisely a victim of the distribution of pornographic videos and was not made a suspect because the video was only for personal gain and had no intention of disseminating it to the general public.]]>
