PERLINDUNGAN HUKUM BAGI PENGUSAHA DALAM PERJANJIAN WARALABA ACK FRIED CHICKEN

Secara konsep waralaba dari ACK Fried Chicken, ACK Fried Chicken memfokuskan bisnis waralabanya pada kios Fried Chicken. Pihak ACK Fried Chicken sebagai franchisor mempunyai standar yang harus dipenuhi pihak franchisee namun pada kenyataan das sollen dan das sein tidak berjalan dengan sebagaimana mestinya. Tujuan dari penelitian ini adalah untuk mengetahui faktor penyebab sehingga pihak franchisee dikatakan wanprestasi dan untuk mengkaji upaya penyelesaian yang dilakukan apabila franchisee melakukan wanprestasi pada perjanjian waralaba ACK Fried Chicken. Metode penelitian ini adalah penelitian hukum empiris. Hasil studi menunjukkan faktor yang menyebabkan terjadinya wanprestasi pada ACK Fried Chicken adalah harga bahan baku dari ACK Fried Chicken lebih mahal dari harga produk di pasar swalayan dan pihak franchisee yang tidak mau membayar royalty sebesar sepuluh persen kepada pihak franchisor. Upaya penyelesaian yang dilakukan pada franchise melakukan wanprestasi pada perjanjian waralaba adalah dengan upaya kekeluargaan berupa diskusi bersama antara kedua belah pihak. Dan pihak ACK Fried Chicken dapat mencabut izin waralaba dari pihak franchisee apabila permasalahan tidak dapat terselesaikan melalui upaya kekeluargaan. In a franchise concept from ACK Fried Chicken, ACK Fried Chicken focuses its franchise business on Fried Chicken kiosks. ACK Fried Chicken as a franchisor has a standard that must be met by the franchisee, but in reality das sollen and das sein do not go as they should. The purpose of this research is to find out the causal factors so that the franchisee is said to be in default and to review the remedies that are carried out if the franchisee does an ACK Fried Chicken franchise agreement. This research method is empirical legal research. The results of the study show that the factors causing the default in ACK Fried Chicken is the price of raw materials from ACK Fried Chicken is more expensive than the price of the product in the supermarket and the franchisee does not want to pay a royalty of ten percent to the franchisor. Settlement efforts carried out on the franchisee defaulting on the franchise agreement are through family efforts between the two parties. And the ACK Fried Chicken can revoke the franchise license from the franchisee if the problem cannot be resolved through family efforts.
