PENJAMINAN PROYEK KERJASAMA PEMERINTAH DENGAN BADAN USAHA MELALUI BADAN USAHA MILIK NEGARA DITINJAU DARI HUKUM JAMINAN

ABSTRAK Dalam pembangunan infrastruktur terdapat keterbatasan biaya investasi, sehingga upaya-upaya awal untuk menghasilkan sumber dana yang ada disini menjadi sangat penting. Pemerintah pada gilirannya akan membuka pintu selebar-lebarnya bagi peran serta dunia usaha (sektor swasta) dalam suatu program kemitraan sesuai regulasi pemerintah yang berlaku yang dapat ditempuh dengan skema Kerjasama Pemerintah dan Badan Usaha (KPBU) melalui Prakarsa Badan Usaha (Unsolicited). Perlu diingat negara Republik Indonesia memiliki corak welfare state yang mengutamakan kepentingan seluruh rakyat. Hal ini dapat dilihat dalam Pasal 33 UUD Tahun 1945 dimana kemakmuran masyarakat yang diutamakan. Dengan demikian tugas pemerintah semakin kompleks. Kecenderungan demikian maka negara hukum saat ini sudah mengarah kepada suatu welfare state, yaitu suatu negara dalam bestuurszorg-nya juga melaksanakan tugas-tugas kesejahteraan umum dengan mengarah pada tujuan negara (Staatsdoel). Kata kunci: CSR; industri rumah tangga pangan; usaha mikro kecil. ABSTRACT On infrastructure development there are limited investment costs, causing the initial efforts to produce sources of funds become very important. The government would turn the investment into business world (private sector) with huge welcome in a partnership program in accordance with applicable government regulations that can be pursued with the Government and Business Entity (PPP) scheme through the Business Entity Initiative (Unsolicited). On the bold line we have to remember that the Republic of Indonesia is a welfare state that prioritizes the interests of all people. This can be seen in Article 33 of the 1945 Constitution where people's welfare is prioritized. Thus the task of the government is complex. Such a tendency then the legal state has now led to a welfare state, that is, a country in its bestuurszorg also carries out public welfare tasks by aiming at the country's goals (Staatsdoel).
