<![CDATA[ABSTRAKObjek pembahasan dalam kajian putusan ini adalah Putusan Nomor 25/Pdt.G/2014/PN.Dps yang memutus perkara sengketa sertipikat ganda yang mengakibatkan tidak adanya kepastian atas kepemilikan sebidang tanah. Penulisan kajian putusan ini menggunakan metode penelitian eksplanatoris dengan berdasar kepada penilaian atas objek yang pantas untuk diteliti dan memilih kajian terhadap Putusan Pengadilan Negeri Denpasar tertanggal 25 Agustus 2014 tersebut, setelah dilakukan observasi secara berkala terhadap proses hukum sampai dijatuhkan putusan. Kajian ini menggarisbawahi bahwa salah satu tugas pokok pengadilan adalah untuk menyelesaikan sengketa terhadap perkara yang ditangani dan memberikan manfaat positif terhadap para pihak. Dalam penyelesaian sengketa, majelis hakim harus menjatuhkan putusan yang mencerminkan rasa keadilan dan harus mempertimbangkan sisi kemanfaatan. Putusan yang dijatuhkan idealnya dapat memberikan manfaat yang positif, bukan malah menimbulkan dampak negatif kepada masyarakat supaya putusan yang dibuat oleh majelis hakim yang terhormat dapat berwibawa dan bijaksana. Namun Putusan Nomor 25/Pdt.G/2014/PN.Dps telah berdampak buruk terhadap para pihak. Dalam menyelesaikan perkara yang diajukan oleh para pihak ternyata Pengadilan Negeri Denpasar tidak memutus pada pokok permasalahan, akan tetapi malah mengesahkan alasan-alasan terjadinya perbuatan hukum. Sehingga, putusan yang dikeluarkan tidak menyelesaikan permasalahan antara para pihak, akan tetapi mengembalikan perkara kepada keadaan sebelum diajukan ke pengadilan.Kata kunci: sertipikat hak milik, kemanfaatan, keadilan, kepastian hukum.ABSTRACTThe object of the discussion in this analysis is Court Decision Number 25/Pdt.G/2014/PN.Dps ruling a dispute of double certificates of freehold titles resulting in lack of certainty over the ownership of a plot of land. This analysis uses explanatory research method, which is based on the assessment of the appropriateness of objects to discuss, then defines the object of study for analysis, that is the Denpasar District Court’s Decision issued on 25 August 2014, after regular observation of the proceedings until the judge pass the decision. This analysis underlines that one of the main tasks of the courts is to resolve disputes in the case and put forward positive benefits to the parties. In the resolution of the dispute, the judge should reflect and regard a sense of justice and expediency in the decision. The decision imposed should ideally provide definite benefits rather than a negative impact on the society, in order that the decision made by the panel of honorable judges would be dignified and expedient. However, the Decision Number25/Pdt.G/2014/PN.Dps has adversely affected the parties. In resolving case filed by the parties, Denpasar District Court in fact did not make up mind the issue, but only validates the reasons for legal actions. Thus, the decision issued does not solve the problem between the parties, but in fact restore the case to the condition prior to submission to the court.
