<![CDATA[ABSTRAKPaten sebagai konstruksi hukum memberikan perlindungan hukum bagi penemuan yang memenuhi persyaratan paten, yaitu: unsur kebaruan dari penemuan; langkah inventif yang terkandung dalam penemuan; serta dapat atau tidaknya penemuan diterapkan dalam industri. Untuk menciptakan kepastian hukum dan keadilan, hakim harus memperhatikan spesifikasi paten (dalam klaim) dan kebaruan penemuan tersebut di seluruh dunia, juga function-way-result test, terutama dalam kasus ini. Dalam pengajuan paten diwajibkan untuk mengungkapkan secara tepat unsur-unsur dari penemuan yang dimintakan perlindungan. Dengan demikian, dalam aplikasi hendaklah tertulis deskripsi tentang esensi dari penemuan. Ruang lingkup atau luasnya perlindungan paten tergantung pada klaim, klaim menunjukkan inti dari penemuan, sehingga untuk menilai pelanggaran paten tergantung pada interpretasi klaim, filing date, state of the art dan cakupan klaim paten terdahulu (prior art).Kata kunci: paten, worldwide novelty, function-way-result test. ABSTRACT Patent as legal construction gives legal protection for the invention which fulfills requirements for a patentable invention, such as: novelty, non-obviousness/ inventive steps and industrial applicability. In order to create legal certainty and justice, the judge should pay attention to the specification of patent (in the claim) and the application of worldwide novelty, also function way result test, especially in this case. In the claim, it is required to state and clarify precisely the elements of invention for which protection is sought. Thus, the claim should be composed of a description or explanation of the essence of the invention. The scope or the extent of patent protection is based on the claim. The essence of protection also depends on the claim; therefore the infringement depends on the interpretation of the claim, filing date, state of the art and prior art scope of the claim.Keywords: patent, worldwide novelty, function-way-result test.]]>
