ABSTRAKKualitas dan kredibilitas seorang hakim ditentukan oleh putusan yang dibuatnya, sebagaimana ungkapan bahwa mahkota atau wibawa hakim terletak pada putusannya. Kewibawaan hakim akan luntur dengan sendirinya kalau putusan-putusannya tidak berpihak lagi kepada nilai-nilai kebenaran dan keadilan. Tulisan ini ingin membedah putusan yang dianggap kontroversial dan berkonotasi negatif, yaitu putusan MARI No. 36 P/Hum/2011, yang dipandang tidak memenuhi aspek prosedural dan material, jauh dari nilai-nilai kepastian dan keadilan, bahkan terdapat sinyalemen adanya konflik kepentingan. Putusan memperlihatkan kekuasaan lebih dominan daripada hakikat kebenaran itu sendiri, yang memperlihatkan masih kentalnya arogansi birokrasi MARI dalam penegakanhukum dan membuktikan bahwa nalar, nurani dan moralitas hakim perlu mendapat perhatian utama dalam peningkatan kapasitas hakim, khususnya yang diselenggarakan oleh Komisi Yudisial. Kata kunci: kode etik, profesionalisme, kebenaran, keadilan.ABSTRACTCourt decisions are the crown of judges’ performance and regarded as one of the most obvious indicators of their quality and credibility. The prestige of this respected profession will dwindle gradually whenever majority of their decisions are considered controversial signalling negative connotation by not seriously taking truth and justice into account. One of such controversial decisions is the supreme court ruling No. 36 P/Hum/2011. Not only does it fail to conform the procedural and material aspects, but also it shows the conflict of interest within the judicial power itself. The decision denotes that power is more dominant rather than truth in term of law enforcement. In addition, the decision reveals that strong arrogant atmosphere in the supreme court’s beaurocratic culture still exist. The author of this article recommends that legal reasoning, morality, and conscience are those of materials that should be added in the materials of judges’ capacity upgradings held by the Judicial Commission.
