Tinjauan Terhadap Asas Presumption of Guilt dalam Keadaan Tertangkap Tangan Tindak Pidana “Kepemilikan” Narkotika Sebagai Upaya Penegakan Hak Asasi Tersangka

Abstrak Penerapan asas praduga bersalah dalam tindak pidana narkotika berlaku sejak keadaan tertangkap tangan hingga dalam proses peradilan. Hal ini dinilai mencederai hak asasi tersangka, dikarenakan tidak sesuai dengan asas persamaan di mata hukum sebagaimana yang diamanatkan dalam ICCPR dan Pasal 28 I ayat (5) UUD 1945. Penerapan asas praduga bersalah ini terjadi dalam kasus yang dialami oleh Devi Syahputra. Devi diduga “memiliki” narkotika jenis shabu-shabu, hingga kemudian dalam putusan pengadilan jaksa tidak berhasil membuktikan bahwa Devi terbukti “memiliki” shabu-shabu tersebut. Hal ini membuktikan bahwa asas praduga bersalah dalam beberapa kasus diterapkan dalam penanganan tindak pidana narkotika patut dikritisi mengingat konsepnya yang sangat berbeda dengan asas praduga tak bersalah. Dan juga rentan mencederai hak tersangka untuk mendapatkan persamaan di mata hukum. Kata Kunci: Presumption of guilt, asas hukum pidana, tertangkap tangan, tindak pidana narkotika, hak asasi manusia Abstract Implementation on the principle of presumption of guilt in narcotics criminal offense applied since the suspect is caught-handed until judicial procedure. This phenomena might be considered as an infringement for the suspect’s rights, since it is not reciprocal with the principle of equality before the law as its written in ICCPR and Article 28 I (5) UUD 1945. The implementation of the principle of presumption of guilt is happened in Devi Syahputra’s case. Devi was suspected to “have” narcotics, in specifically is shabu-shabu, until the prosecutor failed to prove that Devi indeed “have” those shabu-shabu. This proved that the principle of presumption of guilt which implemented in the narcotics criminal offense must be criticized, since the concept itself has a distinction with the principle of presumption of innocence. Also, it susceptive to violate the suspect’s rights to have equality before the law. Keywords: caught-handed, human rights, narcotics crime, presumption of guilt, principle of criminal law.
