PERLINDUNGAN HUKUM DESAIN INDUSTRI TERHADAP SHORT LIFE-CYCLE PRODUCTS BERDASARKAN UNDANG-UNDANG NOMOR 31 TAHUN 2000 TENTANG DESAIN INDUSTRI

Haryono No. 169 Malange-mail: [e-mail] Penulis mengangkat permasalahan mengenai perlindungan hukum desain industri terhadap Short Life-Cycle Products berdasarkan Undang-Undang Nomor 31 Tahun2000 tentang Desain Industri oleh karena maraknya knock-off culture atau budayameniru dalam dunia desain, khususnya pada produk desain industri yang memilikisiklus hidup yang singkat (Short Life-Cycle Products). Dalam hal ini, lamanya jangkawaktu perlindungan hukum desain industri oleh Undang-Undang Nomor 31 Tahun2000 tentang Desain Industri masih dirasa belum sesuai dengan singkatnya jangkawaktu dari Short Life-Cycle Products yang hanya berlangsung selama kurang lebih 1(satu) sampai dengan 6 (enam) tahun. Karya tulis ini mengangkat 2 (dua) rumusanmasalah: (1) Bagaimana perlindungan hukum desain industri terhadap Short Life-Cycle Products berdasarkan Undang-Undang Nomor 31 Tahun 2000 Tentang DesainIndustri? (2) Bagaimana perbandingan ketentuan hukum desain industri terhadap Short Life-Cycle Products antara Undang-Undang Nomor 31 Tahun 2000 tentangDesain Industri dengan Australian Design Act 2003 dan EU Council Regulation (EC)No. 6/2002 on Community Design? dengan menggunakan metode yuridis normatifdengan pendekatan perundang-undangan (statute approach) dan pendekatankomparatif (comparative approach). Hasil penelitian ini menunjukkan bahwaperlindungan hukum desain industri terhadap Short Life-Cycle Products masih belumcukup bila dibandingkan dengan ketentuan desain industri di negara-negara UniEropa.Kata Kunci: Perlindungan Hukum, Desain Industri, Short Life-Cycle Products Abstract This research topic departs from the rising trend of knock-off culture especially inindustrial design with its Short-Life Cycle Products. The term of the legal protection ofindustrial design under the Law Number 31 of 2000 concerning Industrial Design isnot relevant to the short life-cycle products that last less than a year or just six months.This research investigates: (1) how is the legal protection given for this industrialdesign over the Short-Life Cycle Products according to Law Number 31 of 2000concerning Industrial Design? (2) How is industrial design of this Short-Life CycleProducts governed in Law Number 31 of 2000, Australian Design Act 2003, and EUCouncil Regulation (EC) No. 6/2002 on Community Design? With normative juridicalmethod, statutory, and comparative approach, this research has revealed that thelegal protection over the industrial design of Short-Life Cycle Products has not beensufficiently implemented compared to that governed in the provisions of industrialdesigns in other countries of European Union.Keywords: Legal Protection, Industrial Design, Short-Life Cycle Products
