Muhammad Alif Zuhdi, Sihabudin, Ranitya Ganindha Fakultas Hukum Universitas Brawijaya e-mail: malifzuhdi@student.ub.ac.id  ABSTRAK Otoritas perbankan di Indonesia mencatat adanya peningkatan rasio kredit bermasalah atau non-performing loan (NPL) pada masa Pandemi COVID-19 di Indonesia sebagai suatu fakta empiris. Perbankan dihadapkan dengan variabel yang mempengaruhi tingkat kesehatan bank. Kebijakan dimasa darurat pada sektor hukum perbankan melulu mengatur kegiatan bank dalam menyalurkan dana kepada masyarakat (lending). Aktivitas bank dalam menghimpun dana masyarakat (funding) juga perlu dianalisis dari perspektif hukumnya. Aktivitas bank menghimpun dana dari masyarakat erat hubungannya dengan nasabah deposan. Analisis penulis menggunakan metode yuridis normatif dengan pendekatan undang-undang (statue approach), pendekatan sejarah, dan sedikit pendekatan perbandingan melalui Undang-Undang Lembaga Penjamin Simpanan (UU LPS) ditemukan adanya ketidak lengkapan norma hukum mengenai perlindungan hukum terhadap nasabah deposan karena belum menjangkau persoalan mengenai bagaimana perlindungan hukum nasabah deposan ketika terjadi kondisi luar biasa yang tidak pernah diduga-duga sebelumnya seperti pandemi berserta akibat-akibat yang ditimbulkannya padahal hukum perbankan positif secara imperatif menyatakan adanya penjaminan simpanan nasabah deposan. Pasal 10 dan pasal 16 UU LPS belum mampu mampu memberi penjelasan yang detail, jelas, dan spesifik sejauh mana dan dalam kondisi apa saja simpanan nasabah deposan itu dijamin. Reformulasi kebijakan melalui penormaan perlindungan hukum nasabah deposan dalam UU LPS yang tegas, antisipatif, progresif, adaptif, limitatif dan konsisten sebenarnya juga merupakan bentuk pemenuhan dan penegasan doktrin limited guarantee penjaminan simpanan di Indonesia. Kata kunci: Perlindungan hukum nasabah, Nasabah deposan ABSTRACT The case of non-performing loan (NPL) is seen to show increasing trends during the pandemic of COVID-19 in Indonesia, Indonesian Banking Data has reported. This phenomenon is an empirical fact. Banks are faced with variables that could affect bank performance. Banking policies made amidst the pandemic have pushed banks to lend money to customers. Banking activities in funding people’s needs also require analyses from a legal perspective. Funds collected from the members of public are closely related to depositors. This research employed a normative-juridical method, statutory and historical approaches, and a small portion of comparative approach involving the study of Law concerning Deposit Insurance (UU LPS). From the data analysis, it is reported that the related norm is incomplete in terms of the legal protection of bank depositors since the existing law has not reached the extent in which unexpected and extraordinary phenomenon like the spread of COVID-19 takes place and affects almost all existing sectors, while the positive banking law imperatively implies that deposit insurance could serve as a reference. Article 10 and 16 of UU LPS cannot elaborate on the extent and under what condition the clients’ deposit is insured. The straightforward, anticipative, progressive, adaptive, limiting, and consistent reformulation of policies by reforming the norms concerning the legal protection of the depositors in UU LPS could help fulfil and assert the doctrine of limited guarantee of deposit insurance in Indonesia.
