Abstract

Ricardo Tumpal Naibaho, Herman Suryokumoro, Yasniar Rachmawati Fakultas Hukum, Universitas Brawijaya e-mail: ricardonaibaho@student.ub.ac.id   ABSTRAK Penelitian ini bertujuan untuk menganalisis urgensi dari pengaturan penggunaan senjata berbasis artificial intelligence dalam hukum humaniter internasional. Penelitian ini menggunakan jenis penelitian yuridis-normatif dengan pendekatan perundang-undangan dan konseptual. Berdasarkan hasil penelitian, terdapat urgensi untuk mengatur senjata berbasis artificial intelligence karena penggunaannya belum diatur di dalam suatu instrumen internasional yang mengikat. Oleh karena itu, diperlukan suatu pengaturan yang secara spesifik mengenai penggunaan senjata berbasis artificial intelligence dan batasan-batasannya agar dapat mematuhi prinsip-prinsip dasar dalam hukum humaniter internasional.Kata Kunci: Artificial Intelligence, Hukum Humaniter Internasional, Pengaturan Senjata ABSTRACT This research aims to find out and analyse the urgency of the regulations regarding the use of Artificial Intelligence-based weapons according to International Humanitarian Law. With a normative-juridical method, statutory and conceptual approaches, this research concludes that the use of these weapons require regulations. However, Artificial Intelligence-based weapons, recalling that they are categorized as a new type of weapons, are not yet governed by a law that is binding. Moreover, the use of these types of weapons often violates the fundamentals of international humanitarian law. Thus, more specific and binding regulations regarding the limitation and the use of such weapons are required to comply with the principles of international humanitarian law.
