PERLINDUNGAN HUKUM TERKAIT RIWAYAT KESEHATAN PASIEN SETELAH BERLAKUNYA UNDANG-UNDANG NOMOR 14 TAHUN 2008 TENTANG KETERBUKAAN INFORMASI PUBLIK

 Pengaturan dan penyelenggaraan sistem informasi publik dilaksanakan oleh Pemerintah, termasuk sistem informasi kesehatan. Pengembangan sistem informasi kesehatan yang  dilakukan melalui sistem pelaporan, pendataan dan pemetaan kasus-kasus kesehatan, termasuk kejadian penyakit. Melalui sistem informasi kesehatan inilah pemerintah memberikan kemudahan bagi masyarakat untuk memperoleh hak akses terhadap pelayanan kesehatan dalam upaya meningkatkan derajat kesehatan masyarakat. Hak atas informasi kesehatan sendiri merupakan hak dasar sosial yakni the rights to health care yang bersumber dari hak asasi manusia. Sementara itu, dalam pelayanan kesehatan dikenal adanya hak atas rahasia medis (medical secrecy). Pada Undang-undang  Keterbukaan Informasi Publik, diatur pula bahwa informasi kesehatan termasuk informasi publik, tetapi informasi kesehatan yang berisi data kesehatan seseorang termasuk informasi yang dikecualikan untuk dibuka kepada publik. Bagaimana jika hal tersebut terkait dengan medikolegal yang mana mengharuskan seorang dokter untuk membuka rekam medis pasien untuk kepentingan hukum.  The regulation and operation of the public information system are carried out by the Government, including the health information system. Development of a helath information system that carried out hrough this health information system, the government makes it easy for the public to obtain access right to health services in an effort to improve the degree of public health. The right to health information itself is a basic  social right, the rights to to health care sourced from human rights. Meanwhile, health services are known to have the right to medical secrecy. In the public Information Disclosure Act, it is also regulated that health information includes public information, but health information that contains a person’s health data includes information  that is excluded from disclosure to the public. What if it is related to medicolegal which requires a doctor to open a patient’s medical record for legal purposes.
