Infak Masjid At Taufiq Pailus Untuk Pembiayaan Menurut Maqasid Al-Syariah Jasser Auda

This study aims to determine the effectiveness of the use of mosque infaq funds in qard} financing and to determine the analysis of the use of mosque infaq funds in qard} financing from the perspective of Maq>as{id al-Sya>ri’ah Jasser Auda. The type of research carried out is field research (Field Research), which is carried out by going directly to the At-Taufiq Mosque, which is the object, namely in Hamlet Pailus RT 07/03, Karanggondang Village, Mlonggo District, Jepara. The data collection techniques that researchers use are observation, interviews, and documentation. The researchers conducted an analysis using a descriptive qualitative analysis method with the concept of the features of the Maq>as{id al-Sya>ri’ah Jasser Auda system in the form of 'cognition' of Islamic law, the overall scope of Islamic law, openness in the law-making process, interplaying hierarchies, multidimensionality of legal coverage, and understanding of the philosophical intent of Shari'a. Based on the research method used above, it can be concluded that, first, the use of infaq funds at the At-Taufiq Mosque for qard} is considered very effective and functional in terms of the level of problem solving of the qard} practice towards problems that exist in the community around the At-Masjid At-Taufiq. Because in system features, the effectiveness of something is judged by the achievement of its goals. Second, the law on the use of infaq funds at the At-Taufiq Mosque for qard} in the perspective of Maq>as{id al-Sya>ri’ah Jasser Auda is lawful and permissible. It is even recommended to consider the purpose of its use. Maq>as{id al-Sya>ri’ah allows the principles of nas} to be explored in a kulliyah manner and outperforms the historicity of fiqh decisions.Penelitian ini bertujuan untuk mengetahui efektivitas penggunaan dana infak masjid dalam pembiayaan qard} serta untuk mengetahui analisis penggunaan dana infak masjid dalam pembiayaan qard} dalam perspektif Maq>as{id al-Sya>ri’ah Jasser Auda. Jenis penelitian yang dilakukan adalah penelitian lapangan (Field Research) yang dilakukan dengan cara terjun langsung ke Masjid At-Taufiq yang menjadi objek yaitu di Dukuh Pailus RT 07/03, Desa Karanggondang, Kecamatan Mlonggo, Jepara. Teknik pengumpulan data yang peneliti gunakan adalah observasi, wawancara dan dokumentasi. Setelah data terkumpul, maka peneliti melakukan analisis dengan metode deksriptif analisis kualitatif dengan konsep fitur sistem Maq>as{id al-Sya>ri’ah Jasser Auda berupa ‘kognisi’ hukum Islam, kemenyeluruhan cakupan dari syariat Islam, keterbukaan dalam proses pengambilan hukum, hierarki yang saling mempengaruhi, multidimensionalitas cakupan hukum, dan pemahaman akan maksud filsafat dari syariat. Berdasarkan metode penelitian yang digunakan di atas, dapat disimpulkan bahwa, pertama, pemanfaatan dana infak di Masjid At-Taufiq untuk qard} dinilai sangat efektif dan fungsional dilihat dari tingkat problem solving dari praktik qard} tersebut terhadap permasalahan yang ada dalam masyarakat sekitar Masjid At-Taufiq. Karena dalam fitur sistem, efektivitas sesuatu dinilai dari pencapaian akan tujuannya. Kedua, Hukum pemanfaatan dana infak Masjid At-Taufiq untuk qard} dalam perspektif Maq>as{id al-Sya>ri’ah Jasser Auda adalah halal atau boleh, bahkan dianjurkan menimbang tujuan dari pemanfaatannya. Konsep ‘fitur sistem’ Maq>as{id al-Sya>ri’ah Jasser Auda memungkinkan prinsip-prinsip nas} digali secara kulliyah dan mengungguli historisitas keputusan fikih.
