PERAN BADAN PENGAWAS PEMILIHAN UMUM DALAM PENYELESAIAN SENGKETA PROSES PEMILU TAHUN 2019

 Jika dilihat dari beberapa kewenangan Bawaslu, kewenangan penyelesaian sengketa proses merupakan atribusi dari kekuasaan kehakiman (quasi yudisial) yang menjadi mahkota Bawaslu dalam bentuk putusan adjudikasi. Adapun mekanisme penyelesaian sengketa proses pemilu dibedakan menjadi dua mekanisme yaitu: pertama, mekanisme penyelesaian sengketa proses Pemilu di Bawaslu, Bawaslu Provinsi, dan Bawaslu Kabupaten/Kota yang diatur dalam Pasal 466 sampai dengan Pasal 469 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum (UU Pemilu); dan kedua, mekanisme penyelesaian sengketa proses pemilu di Pengadilan Tata Usaha Negara yang diatur dalam Pasal 470 sampai dengan Pasal 472 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Penelitian ini merupakan penelitian hukum yuridis empiris dengan pendekatan yuridis sosiologi, dengan tujuan untuk mengetahui dan menganalisa peran Badan Pengawas Pemilihan Umum (Bawaslu) dalam Penyelesaian Sengketa Proses Pemilu Tahun 2019 di Kota Probolinggo.Kata-Kunci: Bawaslu, Peran, Penyelesaian Sengketa Proses Pemilu.When viewed from some of the authority of Bawaslu, the authority to settle disputes in the process is an attribution of judicial power (quasi-judicial) which is the crown of Bawaslu in the form of adjudication decisions. The dispute resolution mechanism for the election process is divided into two mechanisms, namely: first, the dispute resolution mechanism for the election process in Bawaslu, Provincial Bawaslu, and Regency/Municipal Bawaslu which is regulated in Article 466 to Article 469 of Law Number 7 of 2017 concerning General Elections (Election Law); and second, the dispute resolution mechanism for the election process at the State Administrative Court as regulated in Article 470 to Article 472 of Law Number 7 of 2017 concerning General Elections. This research is an empirical juridical legal research with a sociological juridical approach, with the aim of knowing and analyzing the role of the General Elections Supervisory Body (Bawaslu) in the Dispute Resolution of the 2019 Election Process in Probolinggo City.Keywords: Bawaslu, Role, Dispute Resolution in the Election Process.
