<![CDATA[Abstrak: Penelitian ini bertujuan untuk mengetahui konsep nafkah muaqqat dalam Hukum Islam dan hukum positif. Jenis penelitian ini menggunakan metode kualitatif. Sumber data yang digunakan dalam penelitian ini menggunakan data primer dan data sekunder. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah dokumentasi dan kepustakaan (library research). Hasil penelitian ini adalah terdapat tiga konsep nafkah muaqqat yang ditawarkan. Yang pertama bahwa nafkah itu tidak ada batas waktunya, pendapat ini dipelopori oleh Madzhab Imam Adz-dzahiry yang berdasarkan ayat al-quran “berikanlah nafkah kepada para istri sesuai dengan kemampuanmu sesuai kadar rezekimu”. Yang kedua bahwa batasan nafkah sampai 3 (tiga) hari berturut-turut, pendapat ini dipelopori oleh Madzhab Imam Syafi’i. Pendapat tersebut berdasarkan perkatan dari sahabat Rosulullah sekaligus khalifah ke-2 kaum muslimin yaitu Umar bin Khattab, beliau mengirim pesan kepada pasukan perang yang sedang berada diluar kota. dan yang ketiga adalah batasan nafkah diserahkan kepada pasangan suami istri itu sendiri. Pendapat ketiga ini berdasarkan hukum normatif Indonesia yaitu UUP dan KHI. Didalam aturan tersebut tidak dicantumkan batas waktu yang ditentukan. Melainkan diserahkan kepada yang bersangkutan. Apabila pasangan tersebut mengingkan adanya kepastian dalam memperoleh hak dan kewajibannya, maka mereka berhak untuk mengajukan perjanjian perkawinan atau perjanjian taklik talaq.Kata Kunci: Nafkah; Muaqqat; Hukum Islam Abstract: This study aims to determine the concept of muaqqat living in Islamic law. This type of research uses qualitative methods. Sources of data used in this study using primary data and secondary data. Data collection techniques used in this research are documentation and literature (library research). The results of this study are that there are three concepts of muaqqat living offered. The first is that the living has no time limit, this opinion was pioneered by the Imam Adz-dzahiry Madzhab which based on the verse of the Qur'an "give a living to your wives according to your ability according to the level of your sustenance". The second is that the limitation of living is up to 3 (three) consecutive days, this opinion was pioneered by the Imam Shafi'i School. This opinion is based on the words of a friend of the Prophet as well as the second caliph of the Muslims, namely Umar bin Khattab, he sent a message to the war troops who were outside the city. and the third is the limitation of living left to the husband and wife themselves. This third opinion is based on Indonesian normative law, namely the UUP and KHI. The regulation does not include a specified time limit. Rather, it is up to the person concerned. If the couple wants certainty in obtaining their rights and obligations, then they have the right to apply for a marriage agreement or taklik talaq agreement.Keywords: Livelihood; Muaqqat; Islamic Law]]>
