<![CDATA[Imam Hari Bhakti, Luttfi Effendi, Indah Dwi Qurbani Fakultas Hukum Universitas Brawijaya e-mail: Daengimamhari@gmail.com ABSTRAK Penelitian ini membahas permasalahan hukum empiris yаng menаrik untuk di аnаlisis, yаkni Untuk mengetahui bagaimana Efektivitas penerapan pada Pasal 41 ayat (1) UU Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi, Dapartemen terkait yaitu BPH ( Badan Pengatur Hilir ) Migas memiliki tanggung jawab pengawasan terhadap pelaksanaan kegiatan usaha Minyak dan Gas Bumi. Saat ini banyaknya pelaku usaha Penyedia Bahan Bakar Minyak Digital Elektrik (pertamini) di jakarta yang menjamur tanpa surat izin. Berdаsаrkаn kаsus di аtаs, penulis tertаrik untuk meneliti lebih lаnjut mengenаi bаgаimаnа peran pemerintah khususnya BPH ( Badan Pengatur Hilir ) dalam mengawasi pelaksanaan kegiatan usaha Hilir Minyak dan Gas Bumi Kata Kunci: Efektivitas, Penerapan, Pertamini, Pengawasan, Minyak dan Gas ABSTRACT This study discusses empirical legal issues that are interesting to analyze, namely to find out how the effectiveness of the implementation of Article 41 paragraph (1) of Law Number 22 Year 2001 concerning Oil and Gas, the relevant Ministry, namely BPH (Upstream Regulatory Agency) Oil and Gas has the responsibility of supervising On the implementation of Oil and Gas business activities. Currently, there are many business actors providing Digital Electric Fuel Oil (Pertamini) in Jakarta, which are mushrooming without a permit. Based on the case above, the author is interested in researching further about the role of the government, especially the BPH (Downstream Regulatory Agency) in supervising the implementation of Oil and Gas Downstream business activities.
