Abstrak Realitasnya klausul isi perjanjian kerja dibuat pengusaha. Padahal dalam peraturan perundang-undangan terdapat berbagai asas hukum yang harus diterapkan. Permasalahan penelitian adalah bagaimanakah keabsahan perjanjian Kerja PT A2 Konsultant Management bagi para pekerja dan pemberi kerja dan bagaimanakah berlakunya asas kebebasan berkontrak dalam perjanjian kerja. Tujuan penelitian untuk mengetahui dan menganalisis keabsahan perjanjian kerja berlakunya asas kebebasan berkontrak dalam perjanjian kerja. Manfaat penelitian digunakan sebagai ide gagasan pemerintah dalam pembuatan perjanjian kerja yang melindungi para pihak (Pekerja dan Pemberi Kerja). Jenis penelitian studi Pustaka (library research). Pendekatannya yuridis normatif Data dianalisis secara kualitatif dan disimpulkan secara deduktif. Hasil penelitian menunjukkan bahwa kebebasan berkontrak dalam perjanjian kerja sulit dipraktekkan, karena kedudukan kedua belah pihak berbeda. Pekerja akan tertuju pada syarat klausul yang disediakan pengusaha, akibat posisi para pekerja lebih rendah, sehingga pemerintah perlu menetapkan aturan perundang-undangan ketenagakerjaan, untuk membatasi kebebasan berkontrak dalam perjanjian kerja yang sebenarnya ranah privat. The research problem is how the validity of the work agreement of PT A2 Management Consultant for workers and employers and how it applies as freedom of contract in the work agreement. The purpose of this research is to find out and analyze the validity of the work agreement that applies as freedom of contract in the work agreement. Benefits are used as government ideas in making agreements that protect the parties (Employers and Employers). The type of research is library research. Normative juridical approach The data were analyzed qualitatively and deductively.
