<![CDATA[Tujuan penelitian menganalisis urgensi konsep Negara hukum dan asas-asas umum perundang-undangan, dalam pembentukan peraturan daerah yang demokratis; dan efektivitas penerapan asas-asas demokratis pada pembentukan peraturan daerah di Provinsi Sulawesi Barat. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan yang bersifat Yuridis Empiris. Hasil Penelitian bahwa Penerapan Asas-Asas Demokratis Pada Pembentukan Peraturan Daerah Provinsi Sulawesi Barat, belum berjalan efektif, baik itu diukur dengan unsur substansi hukum, dimana norma hukum masih memberikan kewenangan yan begitu luas bagi aparat, sehingga memiliki potensi terjadinya abuse of power, sedangkan dari struktur hukum, para pemangku kepentingan di Sulawesi Barat belum mampu melibatkan partisipasi masyarakat secara aktif dalam pembentukan peraturan daerah; 2. Faktor-faktor yang mempengaruhi efektivitas pembentukan peraturan daerah adalah : (1) Faktor Internal yakni Sumber Daya Manusia, Sarana, Prasarana dan Keuangan, serta (2) Faktor Eksternal yakni Kurangnya pelibatan dan komunikasi politik dengan rakyat. The research objective to analyze the urgency of the concept of the rule of law and the general principles of legislation, in the formation of democratic regional regulations; and the effectiveness of the application of democratic principles in the formation of regional regulations in the Province of West Sulawesi. The approach used in this study is an empirical juridical approach. The results of the study show that the application of democratic principles in the formation of regional regulations in the province of West Sulawesi has not been effective, whether it is measured by the element of legal substance, where legal norms still give authority so broadly to the apparatus, so that it has the potential for abuse of power. legal structure, stakeholders in West Sulawesi have not been able to actively involve the community in the formation of local regulations; 2. Factors that affect the effectiveness of the formation of regional regulations are: (1) Internal factors, namely Human Resources, Facilities, Infrastructure and Finance, and (2) External factors, namely the lack of political involvement and communication with the people.]]>
