Abstract

Kerugian konsumen dapat menjadi tanggung jawab pelaku usaha/produsen apabila memenuhi syarat dalam prinsip tanggung jawab pelaku usaha. Prinsip-prinsip tanggung jawab tersebut adalah Prinsip tanggung jawab berdasarkan kelalaian/kesalahan (Negligence), Prinsip tanggung jawab berdasarkan wanprestasi (Breach of Warranty), Prinsip tanggung jawab mutlak (Strict Product Liability). Syarat Kerugian Konsumen Yang Menjadi Tanggung Jawab Pelaku Usaha sesuai dengan kasus yang dialami penulis harus memenuhi syarat-syarat sebagai berikut, Suatu tingkah laku yang menimbulkan kerugian, tidak sesuai dengan sikap hati-hati yang normal, Harus dibuktikan bahwa tergugat lalai dalam kewajiban berhati-hati terhadap penggugat, Kelakuan tersebut merupakan penyebab nyata (proximate cause) dari kerugian yang timbul. Kata kunci: Kerugian, Konsumen, Tanggung Jawab, Perdagangan Elektronik, Perlindungan Konsumen Abstract Consumer losses can be the responsibility of the business actor / producer if they meet the requirements in the principle of the responsibility of the business actor. The principles of responsibility are the principle of responsibility based on negligence / error (Negligence), the principle of responsibility based on default (Breach of Warranty), the principle of absolute responsibility (Strict Product Liability). Conditions of Consumer Losses That Become Responsibilities of Business Actors in accordance with the case experienced by the author must meet the following conditions, A behavior that causes harm, not in accordance with normal caution, Must be proven that the defendant was negligent in the duty of caution with the plaintiff, such behavior is the real cause (proximate cause) of the losses incurred.
