PENYELESAIAN KREDIT MACET DI INDONESIA

Abstract

Adanya kredit bermasalah (Non Performing Loan) akan menyebabkan menurunnya pendapatan bank, selanjutnya memungkinkan terjadinya penurunan laba, yang pada akhirnya berindikasi pada sektor perekonomian secara makro. Penanganan kredit bermasalah sebelum diselesaikan secara yudisial dilakukan melalui penjadwalan (rescheduling), persyaratan (reconditioning), dan penataan kembali (restructuring). Penanganan dapat melalui salah satu cara ataupun gabungan dari ketiga cara tersebut. Setelah ditempuh dengan cara tersebut dan tetap tidak ada kemajuan penanganan, selanjutnya diselesaikan secara yudisial melalui jalur pengadilan, pengadilan Niaga, melalui PUPN, dan melalui Lembaga Paksa Badan. Sarana hukum yang dapat dipergunakan untuk mempercepat penyelesaiaan masalah kredit macet perbankan melalui pelaksanaan pasal 1178 ayat (2) KUH Perdata Kreditur Pemegang Hak Tanggungan Pertama dapat diberi kuasa untuk menjual barang agunan dimuka umum untuk melunasi hutang pokok atau bunga yang tidak dibayar oleh debitur sebagaimana mestinya, dan dengan cara pemegang grosse akte dapat mengajukan permohonan kepada Ketua Pengadilan Negeri setempat. Kata kunci: Penyelesaian, Kredit Macet Abstract The existence of non-performing loans (Non-Performing Loans) will cause a decline in bank income, further enabling a decline in profits, which ultimately indicates the macroeconomic sector. Handling of problem loans before being settled judicially is done through scheduling (rescheduling), requirements (reconditioning), and restructuring. Treatment can be through one method or a combination of the three methods. After being pursued in this manner and still no progress in handling, it will then be settled judicially through the courts, the Commercial court, through the PUPN, and through the Forced Agency. Legal facilities that can be used to accelerate the resolution of the problem of bank bad loans through the implementation of Article 1178 paragraph (2) of the Civil Code for Creditors First Mortgage Rights Holders can be authorized to sell collateral in public to repay the principal debt or interest that is not paid by the debtor as it should, and by way of the gross certificate holder can submit an application to the local District Court Chair.
