<![CDATA[Tesis ini mengupas permasalahan perbedaan penafsiran tentang penyidikan kembali oleh para ahli hukum yang berdampak pada implementasi penegakan hukum, sehingga perlu diperjelas terkait pengaturan dan mekanisme penyidikan kembali serta konsep ideal penyidikan kembali berdasarkan ditemukannya alat bukti baru. Jenis penelitian ini adalah penelitian hukum normatif yang menyarankan perlunya mekanisme penerbitan Surat Pemberitahuan Penghentian Penyidikan yang transparan guna berkepastian hukum, revisi frasa “tidak cukup bukti†pada pasal 109 ayat 2 Kitab Undang-Undang Hukum Pidana dan atau menyarankan pengaturan yang jelas dan tegas dalam undang-undang terkait penyidikan kembali. Abstract This thesis explores the problem of different interpretations of the re-investigation by legal experts that has an impact on the implementation of law enforcement, so it needs to be clarified in terms of the regulation and mechanism of re-investigation as well as the ideal concept of re-investigation based on the discovery of new evidence. This type of research is a normative legal research that suggests the need for a transparent mechanism for issuing Termination of Investigation Notice for legal certainty, revision of the phrase "insufficient evidence" in article 109 paragraph 2 of the Criminal Code and and / or recommending clear and firm arrangements in the law laws regarding reinvestigation.
