AbstractRegistration without rights often occurs in well-known brands, because well-known brands are usually attached to a reputation that makes certain parties with bad intentions try to gain profits by hitching or piggybacking on the reputation of famous brands. how is the protection of well-known foreign brands against brand violations according to Law Number 15 of 2001 concerning Trademarks. The type of research conducted is normative legal research. Based on the results of previous research and cases of well-known brand violations, it can be concluded that the protection of well-known local and foreign trademarks in Indonesia has not been carried out in accordance with the provisions of the Trademark Law, TRIPs Agreement, and the Paris Convention because there are still violations - violations of well-known brands and unclear parameters regarding the criteria of famous brands themselves. Keywords:Legal protection, foreign brands, violations. AbstrakPendaftaran tanpa hak seringkali terjadi pada merek terkenal, karena pada merek terkenal biasanya melekat suatu reputasi yang membuat pihak tertentu yang beritikad buruk berusaha meraih keuntungan dengan cara mendompleng atau membonceng reputasi merek terkenal. bagaimanakah perlindungan merek asing terkenal terhadap pelanggaran merek menurut Undang-Undang Nomor 15 Tahun 2001 Tentang Merek. Jenis penelitian yang dilaksanakan adalah penelitian hukum normatif. Berdasarkan dari hasil penelitian dan kasus-kasus pelanggaran merek terkenal yang sudah ada sebelumnya dapat disimpulkan bahwa perlindungan merek dagang terkenal baik lokal maupun asing di Indonesia ini belum dilaksanakan sesuai dengan ketentuan UU Merek, Persetujuan TRIPs, dan Konvensi Paris hal ini dikarenakan masih terdapatnya pelanggaran - pelanggaran terhadap merek terkenal dan belum jelasnya parameter mengenai kriteria merek terkenal itu sendiri. Kata kunci : Perlindungan hukum, merek asing, pelanggaran.
