POLITIK HUKUM PENGANGKATAN ORANG ASLI PAPUA DALAM LEMBAGA PERWAKILAN RAKYAT DAERAH DI PAPUA

Abstract

ABSTRAKAfirmasi bidang politik merupakan salah satu kekhususan otonomi di Papua. Penelitian ini membahas berlakunya aturan hukum mengenai pengangkatan orang asli Papua untuk menjadi anggota Dewan Perwakilan Rakyat Papua (DPRP) dan Dewan Perwakilan Rakyat Kabupaten/Kota (DPRK). Pengumpulan data dilakukan dengan pengamatan, membaca bahan-bahan hukum primer dan sekunder, dan wawancara. Hasil penelitian, sikap politisi lokal yang mendukung aspirasi kemerdekaan Papua melahirkan tuntutan pengangkatan anggota DPRP dari kalangan orang asli Papua yang mendukung integrasi Papua dalam NKRI. Berlakunya aturan hukum pengangkatan anggota DPRP berdasarkan putusan Mahkamah Konstitusi tentang pengujian UU 21/2001 yang mengabulkan permohonan organisasi pejuang Barisan Merah Putih Papua pada tahun 2010. Rendahnya jumlah orang asli Papua yang menjadi anggota DPRK pada beberapa kabupaten/kota di Papua berdasarkan hasil pemilu legislatif 2019 menimbulkan kekecewaan di kalangan orang asli Papua. Untuk mengabulkan tuntutan keberpihakan di bidang politik, pemerintah lebih memilih memberlakukan aturan hukum pengangkatan anggota DPRK dari pada pembentukan partai politik lokal. Kebijakan afirmasi bidang politik ditetapkan dengan pertimbangan kebutuhan nyata orang asli Papua serta stabilitas integrasi bangsa dan kedaulatan negara sehingga tidak semua tuntutan afirmasi bidang politik disetujui pemerintah.Kata kunci: lembaga perwakilan rakyat daerah; pengangkatan; orang asli Papua ABSTRACTAffirmation of the political field is one of the specificities of autonomy in Papua. This research discusses the enactment of the rule regarding the appointment of indigenous Papuans to become members of the Papua People's Representative Council (DPRP) and the Regencies/Municipalities People's Representative Council (DPRK). Data collection is done by observation, reading primary and secondary legal materials, and interviews. As a result of the research, the attitude of local politicians supporting the aspiration of Papuan independence gave birth to demands for the appointment of DPRP members from among indigenous Papuans who supported the integration of Papua in the Republic of Indonesia. The enactment of the law on the appointment of DPRP members based on the Constitutional Court's decision on the judicial review of Law 21/2001 granted the application of the Barisan Merah Putih Papua organization in 2010. The low number of indigenous Papuans who are members of the DPRK in several regencies/municipalities based on the results of the 2019 legislative elections caused disappointment among indigenous Papuans. To grant the demands of partisanship in the political field, the government prefers to impose the rule of law on the appointment of DPRK members rather than the formation of local political parties. The policy of affirmation of the political field is established with consideration of the real indigenous Papuans’ needs as well as the stability of the integration of the nation and state sovereignty so that not all demands for affirmation of the political field are approved by the central government.
