<![CDATA[Studi ini bertujuan untuk mengetahui, memahami serta menganalisa pengaturan Blacklist/Sanksi Daftar Hitam dalam Peraturan LKPP Nomor 17 Tahun 2018 serta sejauh mana implementasi prinsip adil dalam pengenaan sanksi daftar hitam pada pengadaan barang/jasa pemerintah dan pengaruhnya pada penyedia. Metode yang digunakan dalam studi ini adalah metode penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan analisis konsep hukum. Hasil studi menunjukan bahwa pengaturan terkait sanksi daftar hitam dalam Peraturan LKPP Nomor 17 Tahun 2018 perlu dilakukan penyempurnaan agar pelaksanaanya menjadi efektif dan efisien serta tepat sasaran. Prinsip adil belum tercermin pada pelaksanaan sanksi daftar hitam yang mempengaruhi sikap penyedia dalam proses pemilihan peserta pengadaan barang/jasa pemerintah serta berpengaruh terhadap kelangsungan usaha penyedia barang/jasa yang terkena sanksi daftar hitam tersebut. This study aims to find out, understand and analyze the Blacklist Sanctions arrangement in LKPP Regulation Number 17 of 2018 and the extent to which the implementation of fair principles in the imposition of blacklist sanctions on government procurement of goods/services and its effect on providers. The method used in this study is a normative juridical research method with a statute approach and a conceptual approach. The results of the study show that the regulations related to blacklist sanctions in LKPP Regulation Number 17 of 2018 need to be improved so that their implementation is effective and efficient and on target. The principle of fairness has not been reflected in the implementation of blacklist sanctions that affect the attitude of providers in the process of selecting participants for the procurement of government goods/services and affect the business continuity of the goods/services providers who are subject to the blacklist sanctions.]]>
