Haryono No. 169 Malang e-mail: [e-mail] ABSTRAK Penelitian ini mengangkat tentang pelarangan pembukuan dan penerbitan Sertipikat Hak atas Tanah Absentee berdasarkan pada Pasal 30 Ayat (2) Huruf B Permen ATR/Ka.BPN No. 6 Tahun 2018, Kantor Pertanahan kini memiliki alasan untuk dapat menerbitkan Sertipikat Hak atas Tanah Absentee melalui Petunjuk Teknis Pendaftaran Tanah Sistematis Lengkap Tahun 2022, penerbitan itu dilakukan dengan melalui syarat bahwa sang pemohon Hak atas Tanah Absentee menyetujui bahwa dalam waktu 6 bulan akan menempati kecamatan tanah pertanian tersebut atau mengalihkan Hak atas Tanah kepada orang yang berada di kecamatan tanah pertanian tersebut melalui Surat Pernyataan Tanah Absentee. Dalam penelitian ini menggunakan metode sosio legal dengan pendekatan yuridis sosilogis, dalam penelitian ini dapat menemukan bagaimana ketidakefektivan sebuah peraturan tentang pelarangan penerbitan Sertipikat Hak atas Tanah Absentee program Pendaftaran Sistematis Lengkap yang terjadi di masyakarat atau lapangan dan penulis dapat menyimpulkan hambatan dan solusi dari peraturan tersebut melalui Badan Pertanahan Nasional di Kabupaten Malang. Kata Kunci: Sertipikat, Tanah Absentee, Pendaftaran Tanah Sistematis Lengkap, Kantor Pertanahan ABSTRACT This research discusses the prohibition of bookkeeping and issuance of an absentee land certificate according to Article 30 Paragraph (2) letter B of the Regulation of Agrarian and Spatial Planning Minister/the Head of National Land Agency Number 6 of 2018. The land agency can issue an absentee land certificate according to technical guidelines of systematic and comprehensive land registration 2022. This issuance must follow the requirements that require the applicant to reside in the farming land of the district area within 6 months of the issuance or to transfer the right to another person residing in the district concerned, and this approach needs to be made in a written statement regarding absentee land. This research employed socio-legal methods and socio-juridical approaches. This research aims to find out more about the matters regarding the prohibition of the issuance of an absentee land certificate in systematic and comprehensive land registration and concludes that there are factors and solutions regarding this regulation existing in the national land agency in the Regency of Malang.
