Haryono No. 169 Malang e-mail: irqisheva_@student.ub.ac.id ABSTRAK Menelaah politik hukum mengenai DPD yang menyebabkan adanya permasalahan ketimpangan di dalam kelembagaan DPD dan ketidakproporsionalan komposisi yang sama dalam anggota DPD di setiap provinsi.. Hal tersebut dibuktikan dengan bunyi pasal 22C Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD NRI 1945) yang menafsirkan bahwasannya jumlah anggota DPD tidak lebih dari sepertiga jumlah anggota DPR dan anggota DPD di setiap provinsi memiliki jumlah yang sama. Dalam hal ini dapat menimbulkan konflik kelembagaan di dalamnya dikarenakan kedua lembaga tersebut sama-sama dipilih oleh rakyat melalui sistem yang sama yakni pemilihan umum. Dan kedua lembaga tersebut merupakan bagian dari MPR berdasarkan pasal 2 ayat (1) UUD NRI 1945. Kemudian terkait dengan komposisi anggota DPD di setiap provinsi yang sama dinilai tidak proporsional dikarenakan masing-masing daerah berbeda kebutuhannya yang didasari atas luas wilayah dan jumlah penduduknya. penulis menggunakan metode penelitian yuridis normatif dengan pendekatan historis dan pendekatan konsep. Adapun hasil dari penelitian ini yakni politik hukum DPD bersifat dinamis dimulai dari adanya senat hingga utusan daerah. Kemudian terjadi reformasi yang menyebabkan lahirnya DPD sebagai upaya menjaga keutuhan NKRI dan merepresentasikan daerah hingga saat ini. Kemudian setelah mengetahui politik hukum DPD terdapat bentuk penguatan kelembagaannya. Hal tersebut dilihat dari adanya ketimpangan keanggotaan maupun ketidakproporsional komposisi DPD disetiap provinsi. Maka dari itu dilakukan perubahan UUD NRI 1945 untuk menambah jumlah anggota DPD agar sama dengan DPR, kemudian mengenai komposisi anggota di setiap provinsinya tidak sama, melainkan ditentukan berdasarkan luas wilayah dan jumlah penduduknya. Kata Kunci: DPD, Kelembagaan, Politik Hukum, dan Penguatan ABSTRACT Delving into the legal politics regarding Regional Representative Council may cause overlapping problems in the council and an imbalance of composition in the council in every province. This is obvious in Article 22C of the 1945 Constitution of the Republic of Indonesia (henceforth referred to as the Constitution), interpreting that the number of the members of the council should not exceed one-third of the total number of the council’s members, and each council in every province has the same number. This situation can spark institutional conflicts in both councils, considering that these two councils are voted by the members of the public through general elections, and these two councils represent part of the People’s Consultative Assembly according to Article 2 paragraph (1) of the Constitution. The composition of the members of the Regional Council in each province is considered not proportional since every province has its own different needs, area, and population. This research employed normative-juridical methods and historical and conceptual approaches, revealing that the legal politics of the Regional Council is dynamic, and this is represented by the presence of the senate and regional representative members. The reform lies in the fact that the Regional Representative Councils exist to protect the Unitary State of Indonesia and represent regional areas. Institutional reinforcement can be performed after the legal politics of the council is figured out. This is obvious in the disproportional number of the numbers of members and the composition of the council in each province. Thus, the amendments to the Constitution took place in order to add the number of members of the council to reach the same portion of the members in the council.
