Haryono No. 169 Malang e-mail: [e-mail] ABSTRAK Penelitian ini berfokus pada permasalahan terkait Politik Hukum Pelembagaan Pemilihan Kepala Desa dalam Lembaga Hukum Pemilihan Umum di Indonesia. Pemilihan tema tersebut dilatarbelakangi problematika krusial yang tidak diatur secara jelas dan selesai (in complete norm) dalam peraturan perundang-undangan yang membahas pemilihan kepala desa. Permasalahan terdapat pada kelembagaan Pilkades yang berimplikasi terhadap penyelenggara dan pelaksanaannya sehingga berpengaruh pada out put dari Pilkades itu sendiri. Dari permasalahan tersebut, penulis kemudian melakukan penelitian untuk mengetahui dan menganalisa politik hukum pelembagaan pemilihan kepala desa dalam lembaga hukum pemilihan umum di Indonesia. Dari hasil penelitian yang dilakukan oleh penulis, terdapat beberapa dasar pertimbangan terhadap politik hukum pelembagaan pemilihan kepala desa. Yaitu, berdasarkan landasan filosofis, sosiologis, dan yuridis. Serta keraguan atas eksistensi kelembagaan pemilihan kepala desa. Masalah ini bisa muncul karena unsur-unsur organisasi yang dibutuhkan dalam pemilihan kepala desa tidak terintegrasi dan atau yang terbentuk tidak memiliki kewenangan dan kedudukan untuk mengeksekusi secara efektif. Penulis menganggap perlu diaturnya KPU untuk menyelenggarakan dan Bawaslu untuk mengawasi pemilihan kepala desa. Demi tujuan hukum yang lebih mulia, yaitu ketertiban dalam sistem pemilihan kepala desa, dengan menunjuk lembaga yang berkompeten dalam eksekutif, legislatif, dan yudikatif pilkades. Pemberian wewenang kepada Pengadilan Negeri untuk mengadili sengketa hasil pilkades menjadi penting sebab ketertiban menjadi sangat penting karena akan memberikan kebahagiaan bagi masyarakat dengan terselenggaranya pemilihan kepala desa yang baik. Kata Kunci: politik hukum, pemilihan kepala desa, pemilihan umum, tujuan hukum ABSTRACT This research focuses on the problems of legal politics in the Institutionalization of Village Head Elections in a Legal Institution of General Elections in Indonesia. The topic departed from the crucial problems that are not governed appropriately in regulation and are not set forth as a complete norm in the law concerning village head elections. This issue lies in the institutionalization of village head elections, leaving implications on the administration of general elections and the outputs of the village head general elections per se. From this perspective, this research aims to find out and analyze the legal politics of the institutionalization of village head elections within a legal institution of general elections in Indonesia. From the research conducted, some considerations were made regarding the legal politics of the institutionalization of village head elections. According to philosophical, sociological, and juridical principles, and the doubt over the existence of the institutionalization concerned, these problems could emerge because the organizational elements needed in the elections are not integrated, or the established institution does not hold any authority and position to carry out effective execution. Thus, it is necessary to regulate General Election Commission to hold and General Election Supervisory Body to supervise village head general elections. This is all intended to realize the noble objectives of law by creating good order in the system of village head elections by appointing competent and reliable institutions in executive, legislative, and judicative village head general elections. The delegation of the authority to the District Court to judge the disputes of the results of village head elections is crucial simply because social order is paramount in society.
