PEMBENTUKAN IMPERATIVE ENFORCEMENT TREATY UNTUK MENANGANI SAMPAH PLASTIK DI LAUT ASIA PASIFIK

Haryono No. 169 Malang e-mail: [e-mail] Abstrak Penelitian ini bermaksud untuk menguraikan urgensi pembentukan imperative enforcement treaty untuk menangani sampah plastik di laut pada regional Asia Pasifik dengan meninjau aspek kepentingan ekonomi politik negara-negara di kawasan tersebut. Topik ini diambil karena Asia Pasifik merupakan regional penghasil sampah plastik di laut terbesar di dunia, di samping itu masih belum adanya hukum internasional dengan skala regional yang mengatur permasalahan ini. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan perbandingan. Bahan hukum yang digunakan adalah bahan hukum primer, sekunder, dan tersier yang dianalisis dengan metode dekriptif analitis dan penafsiran sistematis. Hasil riset menunjukkan bahwa negara-negara yang berada pada regional Asia Pasifik memiliki ketergantungan tinggi terhadap sumber daya laut baik pada sektor pendapatan negara, ketenagakerjaan, dan ketahanan pangan. Terkait dengan penanganan sampah plastik di laut melalui sudut pandang basis legal, Negara-negara di Asia Pasifik telah berpartisipasi aktif pada politik internasional dengan meratifikasi beberapa aturan internasional dan telah membentuk hukum nasional terkait pelestarian lingkungan laut, namun belum berjalan efektif karena secara fakta empiris, jumlah sampah plastik di laut yang tersebar di Asia Pasifik terus menunjukkan peningkatan. Oleh sebab itu pembentukan imperative enforcement treaty diperlukan untuk mengisi kekosongan hukum pada lingkup Asia Pasifik dalam menangani permasalahan sampah plastik di laut. Kata Kunci: imperative enforcement treaty, kepentingan ekonomi politik, Regional Asia Pasifik Abstract This research aims to elaborate on the urgency of forming an imperative enforcement treaty to deal with plastic waste in the sea in the regional Asia Pacific by looking at the economic and political aspects of the states within this area. This topic departed from the fact that the Asia Pacific is the biggest contributor of waste worldwide and from the absence of international law at a regional level governing this problem. This research employed normative-juridical methods and statutory, conceptual, and comparative approaches. Legal materials consisted of primary, secondary, and tertiary materials analyzed using a descriptive analysis and systematic interpretation. Research results show that the states in the Regional Asia Pacific heavily rely on marine resources in terms of the sector of state revenue, workforce, and food security. Regarding plastic waste handling as seen from the perspective of the legal basis, the states in the Asia Pacific have actively participated in international politics by ratifying several international rules and have formed the national law regarding the conservation of marine environment. However, it has not been effectively implemented since, empirically, the amount of plastic waste in the sea scattered across Asia Pacific keeps increasing and there has not been any international law governing the management of plastic waste polluting the sea. Therefore, the formulation of an imperative enforcement treaty is required to fill the legal loophole within the scope of Asia Pacific in dealing with plastic waste problems.
