Haryono No. 169 Malang e-mail: iqrarahmadi97@gmail.com Abstrak Pada skripsi ini, penulis mengangkat permasalahan mengenai fungsi Otoritas Jasa Keuangan sebagai pelindung nasabah perusahaan leasing Kendaraan bermotor di era pandemi Covid-19. Otoritas Jasa Keuangan yang membentuk Peraturan OJK tentang kebijakan Countercyclical dampak penyebaran Covid-19 bagi jasa keuangan non-bank, dalam peraturan tersebut belum sepenuhnya mengakomodir hak-hak nasabah terkait dengan stimulus kredit yang diprogramkan pemerintah dengan dikaitkan prinsip-prinsip perlindungan konsumen, atas hal ini terdapat kekosongan hukum, dan untuk menjamin kepastian hukum sesuai Undang-Undang Perlindungan Konsumen serta fungsi OJK sebagai panduan perusahaan pembiayaan dalam melaksanakan kegiatan usahanya di era pandemi Covid-19. Berdasarkan permasalahan tersebut diatas, maka muncul rumusan masalah yang diangkat di skripsi ini, yaitu: (1) Bagaimana implikasi yuridis kebijakan countercyclical terhadap perlindungan nasabah perusahaan leasing oleh Otoritas Jasa Keuangan dalam mewujudkan stabilitas di era pandemi? dan; (2) Bagaimana peran Otoritas Jasa Keuangan dalam melakukan perlindungan terhadap nasabah perusahaan leasing di era pandemi Covid-19. Skripsi ini menggunakan metode yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Sebagai bahan hukum, skripsi ini menggunakan bahan hukum primer, sekunder, dan tersier yang akan dianalisis menggunakan metode penafsiran sistematis, penafsiran teleologis, dan penafsiran gramatikal. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa berdasarkan Peraturan OJK tentang Kebijakan Countercyclical dampak penyebaran Covid-19 bagi lembaga jasa keuangan non-bank terdapat kekosongan hukum karena belum terdapatnya sanksi bagi perusahaan pembiayaan apabila tidak melakukan stimulus kredit dan OJK dalam menjalankan fungsinya sebagai pelindung nasabah perusahaan leasing perlu menerapkan upaya hukum prefentif dan represif guna melindungi hak-hak konsumen. Kata Kunci: otoritas jasa keuangan, perusahaan leasing, pandemi covid-19 Abstract This research studies the issue regarding the function of the Financial Services Authority as the protector of the clients of leasing companies providing motorized vehicles purchasing Loan Services during the Covid-19 pandemic. This research departed from the outbreak and the making of the Regulation of Financial Services Authority concerning Countercyclical of the Impacts of the Spread of the pandemic for non-banking finances, where this regulation does not fully accommodate the rights of the clients of leasing companies concerned regarding credit stimuli programmed by the government related to the principles of consumer protection. This condition indicates there is a legal loophole that implies that the legal certainty according to the law concerning Consumer Protection and the function of the Financial Services Authority is required as a guideline for finances in executing their business during the pandemic. Departing from the above issue, this research investigates: (1) How are the juridical implications of countercyclical towards the protection of the clients of leasing companies caused by the Financial Service Authority in realizing stability amidst the pandemic? (2) what is the role of the Financial Services Authority in protecting the clients of leasing companies amidst the pandemic? This research employed normative-juridical methods and statutory and conceptual approaches. Primary, secondary, and tertiary data were analyzed based on systematic, teleological, and grammatical interpretation methods. The research results reveal that regarding the regulation of the Financial Services Authority regarding the countercyclical policy of the impacts caused by the spread of Covid-19 on non-banking financial services, there has been a legal loophole simply because there are no sanctions imposed on leasing companies for not giving any credit stimuli. In this case, the Financial Service Authority in running its function as the protector of the clients needs to apply preventive and repressive legal remedies to protect the rights of the consumers.
