EFEKTIVITAS PASAL 22 AYAT (2) PERATURAN DAERAH KABUPATEN SUMENEP NOMOR 6 TAHUN 2014 TENTANG PELESTARIAN CAGAR BUDAYA (STUDI KASUS CAGAR BUDAYA DI KABUPATEN SUMENEP)

Haryono No. 169 Malang e-mail: [e-mail] Abstrak Penelitian ini bertujuan untuk mengetahui tentang efektivitas Peraturan Daerah Kabupaten Sumenep Nomor 6 Tahun 2014 Tentang Pelestarian Cagar Budaya khususnya pada Pasal 22 Ayat (2) tentang pemberian insentif. Penelitian jurnal ini menggunakan penelitian sosiolegal dengan pendekatan yuridis sosiologis. Hasil dari penelitian ini menunjukkan bahwa pemberian insentif telah diatur dalam Pasal 22 Ayat (2) Perda No 6 Tahun 2022. Namun perda ini belum efektif karena pelaksanaan pemberian insentif belum menyeluruh pada semua cagar budaya di Kabupaten Sumenep hanya Masjid Jamik, Keraton Sumenep, dan Asta Tinggi yang mendapatkan pembiayaan air, listrik, dan fasilitas penunjang. Hal ini terjadi karena dipengaruhi beberapa faktor seperti faktor hukumnya sendiri; faktor penegak hukum; faktor sarana pendukung; faktor masyarakat dan faktor kebudayaan. Faktor utama yang menjadi penghambat tidak efektifnya perda No 6 Tahun 2014 ini adalah faktor hukumnya sendiri yaitu belum adanya aturan pelaksanaan pemberian insentif yang memuat tentang bentuk insentif, besaran insentif, serta klasifikasi cagar budaya yang berhak menerima insentif. Sehingga dengan adanya permasalahan ini juga akan dijelaskan mengenai upaya apa saja yang dapat dilakukan oleh pemerintah agar perda ini menjadi efektif. Kata Kunci: efektivitas, insentif, cagar budaya, peraturan daerah Abstract This research aims to study the effectiveness of the Regional Regulation of the Regency of Sumenep Number 6 of 2014 concerning the Conservation of Cultural Heritage in Article 22 Paragraph (2) concerning Incentive Payment. This research employed a socio-legal method and socio-juridical approach and reveals that incentive payment is regulated in Article 22 Paragraph (2) of Regional Regulation Number 6 of 2022. However, this is deemed ineffective, considering that incentive has not been evenly distributed to all spots of cultural heritage in the Regency ofSumenep. The incentive only reaches the Great Mosque, Sumenep Palace, and Asta Tinggi, covering water and electric bills and other supporting facilities. This uneven distribution of incentives is caused by factors such as law, law enforcers, facilities; society, and culture. However, the main factor causing the ineffectiveness of the implementation of Regional Regulation Number 6 of 2014 is the absence of the delegated regulation of incentive distribution in terms of the type of incentive, the amount, and the classification of cultural heritage that deserves the incentive. This problem should lead further to deciding measures taken by the authorities to allow for effective implementation of the Regional Regulation.
