<![CDATA[This study aims to describe the mudharabah contract in the view of Fiqh muammalah and its practice at PT. Investree Radhika Jaya. The results of the study show, the suitability of Investree's mudharabah with the pillars of mudharabah. First, people who are intelligent in this first pillar, the author sees that both investors and MSME actors have sufficient sense to carry out mudharabah transactions. The two contract objects, in the Investree the contract object has been listed in the project provided by the Investree. Third, the profit sharing has been determined by the Investree, which is 12% to 20%. The four consent granted, Investree as a media liaison between investors and MSME actors provide a letter of willingness to fund because all processes are carried out using an online system. In practice, Mudharabah in the Investree application imposes losses on business actors without the principle of balancing negligence or losses that could occur. The muammalah Fiqh perspective emphasizes that good and bad behavior is not judged based on the impact or results it causes, but because it is mandatory to do it. One of the transparency that is not carried out by the Investree in its marketplace is not providing clear information related to the business benefits and risks of the MSMEs to be funded Penelitian ini bertujuan mendeskripsikan akad mudharabah dalam pandangan Fiqh muammalah dan prakteknya di PT. Investree Radhika Jaya. Hasil penelitian menunjukan, kesesuaian mudharabah Investree dengan rukun mudharabah. Pertama, orang yang berakal dalam rukun pertama ini penulis melihat baik dari sisi investor maupun pelaku UMKM memiliki akal yang cukup untuk melakukan transaksi mudharabah. Kedua objek akad, di dalam Investree objek akad sudah diterterakan dalam project yang disediakan oleh Investree. Ketiga bagi hasilnya, bagi hasil telah ditetapkan oleh pihak Investree yaitu sebesar 12% sampai 20%. Keempat ijab kabul, Investree sebagai media penghubung investor dengan pelaku UMKM memberikan surat kesediaan pendanaan karena semua proses dijalankan dengan sistem online. Prakteknya Mudharabah pada aplikasi Investree membebankan kerugian pada pelaku usaha tanpa adanya asas perimbangan kelalaian atau kerugian yang bisa saja terjadi. Perspektif Fiqh muammalah menegaskan bahwa baik dan buruknya perilaku yang dilakukan tidak dinilai berdasarkan dampak atau hasil yang ditimbulkan, tetapi karena wajib untuk dilakukan.
