IMPLEMENTATION OF ISLAMIC SHARIAH IN THE FRAMEWORK OF SPECIAL AUTONOMY: Assessment Study in the Province of Aceh

Abstrak: Pelaksanaan Syariat Islam Dalam Kerangka Otonomi Khusus: Studi Kajian di Provinsi Aceh. Mengemukanya isu ke publik tentang pelaksanaan syariat Islam di Indonesia, pada dasarnya sudah dimulai sejak saat merumuskan bentuk Negara Indonesia pasca kemerdekaan. Isu tersebut lebih gencar lagi disuarakan pada era reformasi, pasca runtuhnya rezim orde baru, terlebih setelah diberlakukannya Undang-undang Nomor 22 Tahun 1999 tentang Pemerintahan Daerah. Sejalan hal itu, pelaksanaan Syari’at Islam di Provinsi Aceh memiliki legalitas dan diakui dalam konstitusi Negara Republik Indonesia serta sejalan dengan Pancasila dan UUD 1945. Pengakuan Negara terhadap pelaksanaan syariat Islam di Aceh sebagai otonomi khusus, didasarkan pada Undang-undang Nomor 44 Tahun 1999 tentang Penyelenggaraan Keistimewaan Provinsi Daerah Istimewa Aceh dan Undang-undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh. Dari kedua UU tersebut telah disahkan sejumlah qanun di bidang Syariat Islam dalam mempercepat pelaksanaan dan implementasinya di Aceh Abstract: Emergence of the issue to the public on the implementation of Islamic law in Indonesia, basically started when formulating the post-independence Indonesian state form. The issue more aggressively again voiced in the reform era, after the collapse of the New Order regime, especially after the enactment of Law No. 22 of 1999 on Regional Government. Line it is, the implementation of Shariah in Aceh province have a legal and recognized in the constitution of the Republic of Indonesia as well as in line with Pancasila and the 1945 Constitution. Recognition of the state of the implementation of Islamic law in Aceh special autonomy, based on Law Number 44 of 1999 concerning the organization of the privilege of the Special Province of Aceh and Law No. 11 of 2006 on the Governing of Aceh. Of the two laws have been enacted in a number of qanun in accelerating the implementation of Islamic Shariah and its implementation in Aceh.Kata Kunci: Aceh, syariat Islam, otonomi khusus
