STRATEGI PEMBERANTASAN TINDAK PIDANA KORPORASI DALAM KASUS KORUPSI PENGADAAN BARANG DAN JASA PEMERINTAH DI BIDANG KONTRUKSI

ABSTRAK Korupsi dalam pengadaan barang dan jasa adalah yang paling umum dan mudah. Korupsi jenis ini masih bersifat konvensional. Tidak terlalu canggih, dalam hal melakukannya dengan cara seperti penggelembungan harga (markup), penyalahgunaan wewenang. Rumusan dalam penelitian ini adalah Bagaimanakah Strategi Pemberantasan Tindak Pidana Korporasi Dalam Kasus Korupsi Pengadaan Barang Dan Jasa Pemerintah Di Bidang Konstruksi?. Adapun metode penelitian penelitian yang digunakan dalam jurnal ini adalah metode hukum normatif, Dari penelitian ini dapat disimpulkan bahwa Strategi untuk mengurangi tindak pidana korporasi dalam kasus korupsi Pengadaan barang/jasa harus mengikuti prinsip-prinsip pengadaan, yaitu: efisien, efektif, transparan, terbuka, bersaing, adil, dan akuntabel. Pembenntukan Balai Pelaksana Pemilihan Jasa Konstruksi (BP2JK) di Kementerian PUPR pada tahun 2019 merupakan amanat Perpres No.16 Tahun 2018 dan Kepmen PUPR No.228/KPTS/M/2019. BP2JK diharapkan dapat menjadi agen pengadaan Kementerian PUPR yang selalu memegang teguh prinsip-prinsip pengadaan, sehingga dapat dipercaya oleh seluruh masyarakat jasa konstruksi. Kata Kunci: Korupsi, korporasi, pengadaan barang jasa ABSTRACT Corruption in the procurement of goods and services is the most common and easiest. This type of corruption is still conventional. Not very sophisticated in terms of doing it in a way such as markup or abuse of authority. The formulation in this research is "How is the Strategy for Eradication of Corporate Crimes in Cases of Corruption in the Procurement of Government Goods and Services in the Construction Sector?" The research research method used in this journal is the normative legal method, namely, legal research conducted by examining library materials or secondary data. From this research, it can be concluded that the strategy to reduce corporate crime also reduces corruption cases. The procurement of goods and services must follow the procurement principles, namely: efficient, effective, transparent, open, competitive, fair, and accountable. The establishment of the Construction Services Selection Implementation Center (BP2JK) at the Ministry of PUPR in 2019 is a mandate from Presidential Decree No. 16 of 2018 and Minister of PUPR Decree No. 228/KPTS/M/2019. BP2JK is expected to be the procurement agent for the Ministry of PUPR who always adheres to the principles of procurement so that the entire construction service community can trust it.
