PEMBERIAN HAK MILIK DI ATAS TANAH HAK PENGELOLAAN PASCA DIUNDANGKAN UNDANG-UNDANG CIPTA KERJA

Abstract

Pemegang Hak Pengelolaan menurut Undang-Undang Cipta Kerja Nomor 6 Tahun 2023 berwenang memberikan Hak Milik atas sebagian atau seluruh tanah Hak Pengelolaan kepada pihak lain untuk keperluan penggunaan sebuah rumah umum dan keperluan transmigrasi melalui pelepasan tanah Hak Pengelolaan. Akibat pelepasan tanah Hak Pengelolaan, maka Hak Pengelolaan menjadi hapus sehingga tanahnya kembali menjadi tanah negara. Permohonan Hak Milik yang diajukan oleh calon pemilik tanah yang berasal dari pelepasan tanah Hak Pengelolaan kepada Kepala Badan Pertanahan Nasional Republik Indonesia atau pejabat lain yang diberikan pelimpahan kewenangan untuk memberikan Hak Milik berakibat diterbitkannya sebuah Surat Keputusan (SK) Pemberian Hak Milik. Pemohon Hak Milik wajib mendaftarkan SK tersebut kepada Kepala Kantor Pertanahan Kabupaten/Kota setempat sebagai surat tanda bukti hak berupa diterbitkan Sertipikat Hak Milik (SHM). Hubungan hukum antara pemegang Hak Pengelolaan dengan tanah Hak Pengelolaannya akibat dari pemberian Hak Milik atas seluruh atau bagian tanah Hak Pengelolaan kepada pihak lain melalui pelepasan tanah Hak Pengelolaan. Tanah Hak Pengelolaan menjadi hapus, kemudian tanah Hak Pengelolaan kembali menjadi tanah negara. Holder of Management Rights according to Job Creation Law No. 11 of 2020 has the authority to grant ownership rights to part or all of land with management rights to other parties for the purpose of using a public house and for transmigration purposes through the release of management rights land. As a result of the release of the Management Right land, the Management Right is deleted so that the land returns to become state land. Applications for Property Rights submitted by prospective landowners originating from the release of Land Management Rights to the Head of the National Land Agency of the Republic of Indonesia or other officials who are given the delegation of authority to grant Property Rights result in the issuance of a Decree (SK) Granting Property Rights. The applicant for property rights is required to register the decree with the head of the local district/city land office as a proof of title in the form of a certificate of ownership rights (SHM). The legal relationship between the holder of the Management Right and the land with the Management Right results from the granting of a Property Right to all or part of the Management Right land to another party through the release of the Management Right land. The land with management rights is erased, then the land with management rights returns to become state land.
