PENGATURAN JUAL BELI PUTUS: PERSPEKTIF INSTRUMEN KEKAYAAN INTELEKTUAL INTERNASIONAL DAN HUKUM KEKAYAAN INTELEKTUAL DI INDONESIA

Penelitian ini disusun demi mengetahui dan menganalisis pengaturan dan konsekuensi hukum jual beli putus suatu karya cipta dalam perpektif instrumen kekayaan intelektual internasional dan hukum kekayaan intelektual di Indonesia. Penelitian ini merupakan penelitian normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa Perlindungan terhadap hak-hak pencipta diatur dalam Article 9 Berne Convention. Namun Berne Convention tidak mengatur secara eksplisit mengenai jual beli putus suatu karya cipta. Sehingga konsekuensi sebagaimana dimaksud dalam Article 5 Berne Convention terkait dengan peralihan hak cipta dalam hal ini jual beli putus diatur oleh undang-undang negara tempat perlindungan tersebut diminta. Oleh karena itu pengaturan jual beli putus diatur lebih lanjut dalam hukum positif Indonesia tepatnya dalam Undang-Undang No 28 tahun 2014 Tentang Hak Cipta (selanjutnya disebut UUHC). Pengaturan jual beli putus dalam UUHC dapat dikatakan sesuai, mengingat hal ini merupakan bentuk perlindungan bagi kesejahteraan pencipta mengingat sebelum adanya pengaturan mengenai jangka waktu peralihan hak cipta tersebut. This research was compiled tp find out and analyze the arrangement and legal consequences of transfering copyrighted works by sold flat methode in the perspective of international intellectual property instruments and intellectual property law in Indonesia. This research is normative research with statutory and conceptual approaches. The results showed that the protection of the rights of creators is regulated in Article 9 of the Berne Convention. However, the Berne Convention does not explicitly regulate the sold flat of a copyrighted work. So that the consequences referred to in Article 5 of the Berne Convention related to the transfer of copyright in sold flat case is governed by the laws of the country where the protection is requested. Therefore, the arrangement of buying and selling is further regulated in Indonesian positive law precisely in the UUHC. Arrangement of buying and selling broken in the UUHC can be said to be appropriate, considering this is a form of protection for the welfare of the creator considering before the regulation of the term of transfer of copyright.
