Haryono No. 169 Malang e-mail: mifta1999@student.ub.ac.id Abstrak Penelitian ini berdasarkan merek permasalahan yang terjadi di Kota Mojokerto. Semakin meningkatnya jumlah penduduk perjanjian perekenominasi serta gaya hidup masyarakat perkotaan modern, fashionable mengikuti trend, adanya pelaku usaha sangat membantu memenuhi alasan tersebut tetapi menciptakan peningkatan pelanggaran merek menurunkan kualitas perdagangan dan perindustrian. Penelitian ini bertujuan untuk mengetahui bagaimana penerapan perlindungan terhadap penjual merek pelaku usaha di Benteng Pancasila Kota Mojokerto. Dari latar belakang merek tersebut, rumusan masalahnya: apa hambatan dan apa upaya implementasi perlindungan hukum terhadap pujian dagang terkenal ditinjau dari Pasal 83 ayat 1 Undang-Undang No.20 Tahun 2016 Tentang Merek dan Indikasi Geografis Di Benteng Pancasila Kota Mojokerto. Jenis penelitian ini hukum Yuridis Empiris, mendasarkan penelitian lapangan, pendekatan penelitian Yuridis Sosiologis, mengkaji subyek hukum serta efektivitas berlakunya hukum positif di masyarakat. Berdasarkan hasil penelitian ham pybatan dalam penerapan perlindungan merek terhadap persamaan merek dagang terkenal di Benteng Pancasila Kota Mojokerto adalah pelaku usaha khususnya pedagang tidak semua memiliki hasil atau barang yang dihasilkan sendiri belum memahami pentingnya merek serta adanya fasilitas merek yang diberikan pemerintah secara gratis, adapun yang mengerti tetapi tidak mau mendaftarkan karena alasan seperti keuntungan, nama, dan kewenangan terbatas lainnya yang dimiliki penegak hukum Polres Kota Mojokerto akibat tidak adanya laporan dari pemilik merek yang mereknya dipersamakan oleh pihak lain atau menggunakan mereknya tanpa izin karena pembelian merek merupakan delik aduan. Upaya yang telah dilakukan oleh Pemerintah Kota Mojokerto khususnya Dinas Perindustrian dan Perdagangan serta Polres Kota Mojokerto dalam mengatasi masalah penerapan perlindungan hukum. Kata Kunci: implementasi, merek, penegakan hukum, persamaan Abstract This research departed from trademark-related issues in Mojokerto City. The increasing population, the rising trends of economic agreements, lifestyles, and modern and fashionable life in cities have encouraged the presence of businesses. These rising trends, however, will also raise the potential of mark infringement and lower trade and industrial qualities. This research aims to figure out how the protection of mark sellers is implemented in Benteng Pancasila in Mojokerto City. From this background, this research aims to study the impeding factors and the measures in the implementation of legal protection of well-known marks according to Article 83 paragraph 1 of Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Benteng Pancasila, Mojokerto City. This research employed empirical-juridical methods, field observation, and socio-juridical approaches to further study the legal subject and the effectiveness of positive law in society. The research results reveal that not all traders have their own products, and most of them are not quite aware of the essence of marks and the facilities provided free of charge by the government. Similarly, those who understand this matter choose not to register their trademarks due to particular reasons such as benefits, name, and limited authority held by law enforcers in the Sub-Regional Police Department of Mojokerto City since there are no reports from trademark owners whose marks are imitated or used by other parties without consent. Moreover, trademark buying is categorized as a complaint offense. Some measures have been taken by the Industry and Trade Agency and the Sub-Regional Police Department of Mojokerto to guarantee legal protection.
