EKSISTENSI KOPERASI SYARI’AH PASCA PUTUSAN MAHKAMAH KONSTITUSI NOMOR 28/PUU-XI/2013

AbstrakRealitas beragamnya peraturan perundangan yang mengatur tentang kelembagaan Koperasi Syari’ah dan Undang-Undang Nomor 17 Tahun 2012 sebagai pengganti undang undang Nomor  25 Tahun 1992 ,Tentang  Perkoperasian  juga  belum  memberikan  jaminan  kepastian  hukum  bagi kelembagaan koperasi syari’ah, apalagi dengan dibatalkannya pemberlakuan Undang-undang Nomor 17 Tahun 2012 dengan Putusan Mahkamah Konstitusi Nomor 28/PUU-XI/2013. Koperasi Syari’ah sebagai lembaga  ekonomi dalam tataran masyarakat tingkat  bawah  di  sisi  lain,  sehingga    berpengaruh  pada  lemahnya  kelembagaan koperasi tersebut. Tatanan hukum baru, sangat diperlukan bagi tumbuh kembangnya lembaga ekonomi yang dalam hal ini adalah Koperasi Syari’ah, sebagai bagian dari sistem hukum koperasi nasional. Eksistensi Koperasi Syari’ah  Pasca Putusan Mahkamah Konstitusi Nomor 28/PUU-XI/2013, koperasi sebagai badan hukum dan sekaligus sebagai badan usaha   lemah dibandingkan dengan badan-badan usaha lainnya, maka diperlukan adanya Konstruksi norma hukum koperasi syari’ah melalui pembentukan Undang-undang  khusus  Koperasi  Syari’ah  yang  jelas  dan  tegas  serta  berkepastian  hukum.Kata Kunci : Eksistensi, Koperasi syari’ah  Abstract The reality of the diversity of laws and regulations governing cooperative institutional Syari'ah and Law No. 17 of 2012 as a replacement for Law No. 25 of 1992, On Cooperatives also not ensuring legal certainty for cooperative institutions syari’ah, especially with the cancellation of the enforcement of Law No. 17 of 2012 with the Constitutional Court Decision No. 28 / PUU-X / 2013.
