Abstract

Hubungan antara dokter dengan pasien adalah relasi yang amat personal sebab bertumpu kepada kepercayaan pasien terhadap dokter. Sepanjang sejarah, hubungan dokter dan pasien berkembang dalam 3 model yakni  Activity-Passivity Relation, Guidance - Cooperation dan Mutual Participation. Model hubungan Mutual Participation dianggap sebagai fase hubungan terbaik dimana dokter dan pasien berada dalam posisi sejajar dan terikat dengan hukum perikatan, yang dikenal dengan kontrak terapeutik. Di dalam hukum Indonesia, kontrak terapeutik berlandaskan kepada Kitab Hukum Undang Undang Hukum Perdata Buku Ketiga. Penelitian ini adalah penelitian yuridis normatif dengan menelaah berbagai kepustakaan dan pandangan para ahli  dengan tujuan untuk untuk menganalis hubungan hukum antara dokter dan pasien di dalam kontrak terapeutik dari perpspektif yuridis dan non-yuridis. Hasil penelitian ini menyimpulkan bahwa di dalam implementasi kontrak terapeutik, relasi antara dokter dan pasien telah bergeser menjadi relasi perikatan yang sangat kaku. Keadaan ini disebabkan pemahaman  terhadap hukum yang berorientasi positivistik, doktrinal dan dogmatis sehingga mengesampingkan  aspek aspek moral, etik, keluhuran budi,welas asih serta aspek spiritual dan bergesernya karakteristik hubungan dokter pasien yang semula bersifat kemanusiaan menjadi bersifat bisnis dan materialistik.Abstract: The relationship between doctors and their patients is a very personal one, as it is based on the patient's trust in the doctor. Throughout history, the doctor-patient relationship has developed in three models or phases : Activity-Passivity Relation, Guidance-Cooperation, and Mutual Participation. The Mutual Participation model is considered the best phase of the relationship, where doctors and patients are on equal footing and bound by contractual obligations, known as the Therapeutic Contract. In Indonesian law, the therapeutic contract is based on the Civil Code Law, Book Three. This research is a normative legal study that examines various literature and expert opinions, aiming to critically analyze the relationship between doctors and patients within the therapeutic contract. The findings of this study conclude that in the implementation of the therapeutic contract, the relationship between doctors and patients has shifted to a very rigid contractual relationship. This situation is caused by a positivistic, doctrinal, and dogmatic understanding of the law, which overlooks moral, ethical, noble, compassionate, and spiritual aspects. Furthermore, the characteristics of the doctor-patient relationship, which were originally humanitarian, have shifted to become more business-oriented and materialistic.
