<![CDATA[AbstrakIde perumusan hak atas lingkungan yang baik dan sehat muncul pada saat amandemen UUD 1945 yang kedua. Permasalahan ini muncul dan perlunya dimuat dalam ketentuan UUD 1945 karena perkembangan kehidupan dan mobilitas penduduk berakibat pada rusaknya dan tercemarnya lingkungan hidup. Pembentuk amandemem UUD 1945 berusaha memasukan isu lingkungan hidup sebagai hak asasi manusia sebagai wujud dari perlindungan terhadap lingkungan hidup sekaligus juga perlindungan hak asasi manusia. Pada akhirnya rumusan hak atas lingkungan hidup yang baik dan sehat masuk dalam rumusan Pasal 28H ayat (1) UUD 1945 dan rumusan pasal tersebut sebagai norma dasar hukum terhadap perlindungan lingkungan hidup dan hak asasi manusia. Kata kunci: Hak Asasi Manusia, Lingkungan Hidup, Perlindungan.                  AbstractThe idea of formulating the right to a good and healthy environment emerged during the second amendment to the 1945 Constitution. This problem arises and needs to be included in the provisions of the 1945 Constitution because the development of life and mobility of the population results in damage and pollution of the environment. The amendments to the 1945 Constitution seek to include environmental issues as human rights as a form of protection of the environment as well as protection of human rights. In the end, the formulation of the right to a good and healthy environment is included in the formulation of Article 28H paragraph (1) of the 1945 Constitution and the formulation of this article is the basic legal norm for environmental protection and human rights. Keyword: Human Rights, Environment, Protecting.]]>
