<![CDATA[Penelitian ini bertujuan untuk menganalisis bentuk penyertaan (deelneming) yang terjadi dalam tindak pidana pemalsuan Surat Tanda Nomor Kendaraan (STNK) secara berlanjut dan sistem pemidanaan yang diterapkan dalam Putusan Nomor 446/Pid.B/2023/PN/Mks. Penelitian ini menggunakan tipe yuridis normatif. Penelitian lakukan di Pengadilan Negeri Makassar untuk mendapatkan bahan primer berupa wawancara kepada Hakim Pengadilan Negeri dan bahan sekunder berupa peraturan undang-undang, putusan pengadilan dan dokumen lainnya. Hasil penelitian ini menunjukkan bahwa bentuk penyertaan yang terjadi pada Putusan No. 446/Pid.B/2023/Pn MKS adalah Medepleger yaitu turut serta melakukan tindak pidana pemalsuan STNK secara berlanjut. Sistem pemidanaan terhadap tindak pidana penyertaan ialah sistem pidana yang berasal dari Romawi. Adapun sistem pidana Romawi. Berdasarkan sistem ini tiap-tiap peserta penyertaan mempertanggungjawabkan sebagaimana perbuatan masing-masing. This study aims to analyze the form of participation (deelneming) that occurs in the crime of falsification of Vehicle Registration Certificate (STNK) continuously and the punishment system applied in Decision Number 446/Pid.B/2023/PN/Mks. This research was conducted directly at the Makassar District Court. The method used in writing this thesis is the normative method, the primary data sources in this research come from laws and regulations, court decisions and official state documents, and secondary data sources come from publications about law that are not official documents, while for tertiary data sources come from literature studies, while the data analysis method used in writing this thesis is qualitative. The results of this study indicate that the form of participation that occurred in Decision No. 446/Pid.B/2023/Pn MKS is Medepleger, namely participating in the criminal act of STNK forgery continuously. The system of punishment for the crime of participation is the Roman criminal system. The Roman criminal system. Based on this system, each participant is held accountable for their respective actions.]]>
