This study examines the reconstruction of the Criminal Procedure Code concerning judicial pardon (rechterlijk pardon) in the new Criminal Code, with the objective of understanding the concept of judicial forgiveness as outlined in Constitution Number 1 of 2023. It aims to analyse the types of decisions in accordance with Article 191 of the Criminal Procedure Code. persuasive manner in court.
