Abstract

Abstrak Perkembangan pesat financial technology (fintech) lending di Indonesia telah membuka akses pembiayaan yang lebih luas bagi masyarakat dan Usaha Mikro, Kecil, dan Menengah (UMKM), namun juga menghadirkan tantangan regulasi yang kompleks. Otoritas Jasa Keuangan (OJK) sebagai regulator utama telah menerbitkan berbagai peraturan, puncaknya pada Peraturan OJK Nomor 10/POJK.05/2022 (POJK 10/2022), untuk menata industri ini. Meskipun demikian, masih terdapat kesenjangan regulasi (regulatory gap), tumpang tindih kewenangan, dan tantangan dalam perlindungan konsumen serta data pribadi. Artikel ini menganalisis model pengawasan OJK saat ini, mengidentifikasi kelemahan fundamental dalam kerangka regulasi dan koordinasi antarlembaga, serta menawarkan sebuah model pengawasan baru yang terintegrasi dan berbasis teknologi. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan perundang-undangan, konseptual, dan perbandingan, penelitian ini mengusulkan sebuah model yang mengadaptasi prinsip-prinsip ‘Twin Peaks’ yang memisahkan pengawasan prudensial dan perilaku pasar secara lebih tegas, serta mengintegrasikan Regulatory Technology (RegTech) dan Supervisory Technology (SupTech) untuk meningkatkan efektivitas dan efisiensi pengawasan. Kebaruan (novelty) yang ditawarkan adalah kerangka kerja harmonisasi hukum yang konkret antara UU PDP, UU ITE, dan regulasi OJK, serta model koordinasi antarlembaga yang terstruktur untuk mengatasi fragmentasi pengawasan. Hasil penelitian ini diharapkan dapat memberikan kontribusi teoretis dan praktis bagi penyempurnaan arsitektur pengawasan sektor jasa keuangan di era digital. Kata Kunci : Pengawasan OJK, Fintech Lending, Kesenjangan Regulasi, Harmonisasi Hukum, RegTech, SupTech Abstract The rapid development of financial technology (fintech) lending in Indonesia has opened up wider access to financing for the public and Micro, Small, and Medium Enterprises (MSMEs), but it also presents complex regulatory challenges. The Financial Services Authority (OJK) as the main regulator has issued various regulations, culminating in OJK Regulation Number 10/POJK.05/2022 (POJK 10/2022), to regulate this industry. However, there are still regulatory gaps, overlapping authority, and challenges in consumer protection and personal data. This article analyzes the current OJK supervisory model, identifies fundamental weaknesses in the regulatory framework and inter-agency coordination, and offers a new integrated and technology-based supervisory model. Using normative legal research methods through legislative, conceptual, and comparative approaches, this study proposes a model that adapts the 'Twin Peaks' principles that separate prudential supervision and market behavior more decisively, as well as integrate Regulatory Technology (RegTech) and Supervisory Technology (SupTech) to improve the effectiveness and efficiency of supervision. The novelty offered is a concrete legal harmonization framework between the PDP Law, the ITE Law, and OJK regulations, as well as a structured inter-agency coordination model to overcome supervisory fragmentation. The results of this study are expected to make a theoretical and practical contribution to the improvement of the supervision architecture of the financial services sector in the digital era.
