Penanganan Sengketa Konsumen Perumahan Terkait Implikasi Ketidaksesuaian Pemanfaatan Ruang di Kota Tanjungpinang

Abstract

Permasalahan perumahan di Kota Tanjungpinang seperti yang terjadi di beberapa perumahan yang ada di Kota Tanjungpinang telah berdampak merugikan konsumen/pembeli. Masalah tersebut berupa fasiltas umum (fasum) yang mangkrak, status kepemilikan sertipikat, persoalan penyerahan prasarana, sarana dan utilitas umum (PSU) ke pemerintah daerah, dan ketidaksesuaian pemanfaatan ruang. Dari isu masalah, maka tujuan penelitian ini adalah untuk mengidentifikasi ketidaksesuaian pemanfaatan ruang dan implikasinya sehingga menghasilkan penanganan sengketa konsumen perumahan yang efektif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan kualitatif untuk mengidentifikasi kondisi existing dan masalah perumahan yang merugikan konsumen/pembeli. Analisis deskriptif kualitatif dilakukan untuk menganalisis penanganan sengketa konsumen perumahan dengan alat bantu analisis Analogi Bawang Bombay dan collaborative governance. Hasil penelitian menunjukkan ada hubungan ketidaksesuaian pemanfaatan ruang dengan kerugian yang didapat oleh konsumen. Kesimpulan penelitian adalah strategi penanganan sengketa yang lebih efektif dengan cara lain selain melalui cara penyelesaian sengketa konsumen oleh Badan Penyelesaian Sengketa Konsumen (BPSK), yaitu penguatan peran aktif warga perumahan dengan dukungan pihak lain (DPRD, Lembaga Perlindungan Konsumen Swadaya Masyarakat (LPKSM), media pers, kolaborasi antar stakeholder (pemain kunci, pihak pendukung, dan pengikut) dan pembahasan melalui forum penataan ruang Kota Tanjungpinang, sesuai dengan tujuan masing-masing dalam pemecahan masalah Housing problems in Tanjungpinang City, as has occurred in several housing complexes in Tanjungpinang City, have had a detrimental impact on consumers/buyers. These problems include stalled public facilities (fasum), certificate ownership status, problems with handing over Public Infrastructure, Facilities and Utilities (PSU) to the Regional Government, and discrepancies in space utilization. From the problem issue, the aim of this research is to identify discrepancies in space use and their implications so as to produce effective handling of consumer housing disputes. The approach used in this research is a qualitative approach to identify existing conditions and housing problems that are detrimental to consumers/buyers. Descriptive-qualitative analysis was carried out to analyze the handling of consumer housing disputes using the Onion Analogy and Collaborative Governance analysis tools. The results of the research show that there is a relationship between inappropriate use of space and losses incurred by consumers. The conclusion of the research is a more effective dispute handling strategy in other ways than through consumer dispute resolution by the Consumer Dispute Resolution Agency (BPSK), namely strengthening the active role of housing residents with the support of other parties (DPRD, Non-Governmental Consumer Protection Institutions (LPKSM), media press), collaboration between stakeholders (key players, supporters and followers) and discussions through the Tanjungpinang City Spatial Planning Forum, in accordance with their respective goals in solving problems.
