ANALISIS YURIDIS KEKUATAN PEMBUKTIAN PERJANJIAN JUAL BELI HAK ATAS TANAH DI BAWAH TANGAN (Studi Kasus Putusan Pengadilan Negeri Pontianak Nomor 92/Pdt.G/2021/PN.Ptk)

Abstract

 Land Rights Sale and Purchase Agreement, namely an assistance agreement that functions as a preliminary agreement in a free form according to the will of the parties. Agreements for the sale and purchase of land rights between the parties can be carried out in two ways: agreements made privately or through a deed drawn up before the Land Deed Making Officer. This study aims to find out and analyze the judge's considerations in deciding case Number 92/Pdt.G/2021/PN.Ptk and the strength of proof of the Sale and Purchase Agreement of Private Land Rights based on Court Decision Number 92/Pdt.G/2021/PN.Ptk.  The research method that the authors use in this study is normative legal research (normative juridical). This study uses a statute approach and a case approach and will be analyzed using a qualitative analysis method.  The results of the research and discussion show that the strength of proof of the sale and purchase agreement of land rights under the hands based on Court Decision Number 92/Pdt.G/2021/PN.Ptk is the same as an authentic deed because the legal conditions for buying and selling according to the UUPA have been fulfilled, namely the material and formal requirements of cash, clear, and real. The binding power of the sale and purchase also fulfills the legal requirements of an agreement contained in Article 1320 of the Civil Code, and the transfer of land rights based on a sale and purchase agreement legally occurs if the buyer has paid the land price in full, has taken control of the object of the sale and purchase, and is carried out in good faith. In carrying out the buying and selling process, it must be registered and carried out before the Land Deed Making Officer so that it has strong evidentiary power as long as it is not proven otherwise.  Perjanjian   Jual Beli Hak Atas Tanah yaitu suatu perjanjian bantuan yang berfungsi sebagai perjanjian pendahuluan yang bentuknya bebas sesuai dengan kehendak para pihak. Perjanjian Jual Beli Hak Atas Tanah antara para pihak dapat   dilakukan dengan dua cara, yaitu perjanjian yang dibuat di bawah tangan atau dapat pula dilakukan melalui suatu akta yang dibuat dihadapan Pejabat Pembuat Akta Tanah.   Penelitian ini bertujuan untuk mengetahui dan menganalisis pertimbangan hakim dalam memutuskan perkara Nomor 92/Pdt.G/2021/PN.Ptk dan kekuatan pembuktian Perjanjian Jual Beli Hak Atas Tanah dibawah tangan berdasarkan Putusan Pengadilan Nomor 92/Pdt.G/2021/PN.Ptk.Metode penelitian yang penulis gunakan pada penelitian ini adalah penelitian hukum normatif (yuridis normatif). Penelitian ini menggunakan Pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach) dan akan di Analisis menggunakan metode analisis yang bersifat kualititatif.  Hasil penelitian dan pembahasan menunjukkan bahwa kekuatan pembuktian Perjanjian Jual Beli Hak Atas Tanah dibawah tangan berdasarkan Putusan Pengadilan Nomor 92/Pdt.G/2021/PN.Ptk   sama dengan akta autentik, dikarenakan sudah terpenuhinya syarat sahnya jual beli menurut UUPA yakni syarat materiil dan formil yang bersifat tunai, terang, dan riil. Kekuatan mengikat jual beli tersebut juga sudah memenuhi syarat sahnya suatu perjajian yang termuat dalam Pasal 1320 KUHPer dan peralihan hak atas tanah berdasarkan Perjanjian Jual Beli secara hukum terjadi jika pembeli telah membayar lunas harga tanah serta telah menguasai objek jual beli dan dilakukan dengan itikad baik. Dalam melaksanakan proses jual beli   haruslah didaftarkan dan dilakukan dihadapan Pejabat Pembuat Akta Tanah sehingga memiliki kekuatan pembuktian yang kuat sepanjang tidak dibuktikan sebaliknya.
