The child is the future in the family and the heir to the family even if the child is an illegitimate child because the child born should have his rights protected in the position of inheritance. What if the heir leaves an illegitimate child who will become the sole heir of Employment BPJS who will have a lot of interference from other parties if the illegitimate child has no position. So the purpose of this research is for illegitimate children to get rights and positions in inheritance. The research method uses normative laws and empirical (sociological) laws. Article 43 paragraph 1 of the Marriage Law states that a child born out of wedlock only has a civil relationship with his mother and his mother's family. In order for children out of wedlock to receive recognition from their father according to the Constitutional Court Decision No.46/PUU-VIII/2010 if it can be proven by a DNA test then the child is his child so that the child has the opportunity to obtain a birth certificate with father and mother name so that children out of wedlock have the right to inherit BPJS Employment.
