ABSTRACTThe issuance of Building Use Rights Certificates (HGB) Numbers 165 and 360 in the name of PT. Sunindo Property Jaya by the Regional Office of the National Land Agency of Central Java is suspected of administrative legal defects. Anik Rahmawati, the previous landowner, was disadvantaged by duplicate certificates due to overlapping land, leading to a lawsuit in Administrative Court Case Number: 67/G/2017.PTUN.SMG. This study employs a normative juridical method to analyze legal protection for the previous landowner. The findings indicate that the Semarang City Land Office provided repressive legal protection by canceling PT. Sunindo’s HGB through a decree, based on a final court decision in accordance with Article 29 paragraph (2) of ATR Regulation No. 21 of 2020.Keywords: Legal Protection; Certificate; Overlapping.ABSTRAKPenerbitan Sertipikat Hak Guna Bangunan (HGB) Nomor 165 dan 360 atas nama PT. Sunindo Property Jaya oleh Kantor Wilayah Badan Pertanahan Nasional Jawa Tengah diduga cacat hukum administratif. Anik Rahmawati, pemilik tanah sebelumnya, merasa dirugikan karena adanya sertipikat ganda akibat tumpang tindih tanah, yang menjadi dasar gugatan di Pengadilan Tata Usaha Negara (PTUN) Nomor: 67/G/2017.PTUN.SMG. Penelitian ini menggunakan metode yuridis normatif untuk menganalisis perlindungan hukum bagi pemilik tanah sebelumnya. Hasil penelitian menunjukkan bahwa Kantor Pertanahan Kota Semarang telah memberikan perlindungan represif melalui penerbitan SK pembatalan HGB PT. Sunindo berdasarkan putusan pengadilan yang berkekuatan hukum tetap sesuai Pasal 29 ayat (2) Permen ATR No. 21 Tahun 2020.Kata Kunci: Perlindungan Hukum; Sertipikat; Overlapping.
