<![CDATA[The shift in criminal law policy regarding the regulation of corruption has become a crucial issue following the enactment of Law Number 1 of 2023 concerning the Criminal Code (KUHP 2023). This study aims to analyze the paradigm of punishment in the 2023 Criminal Code and examine the direction of legal policy changes from the Corruption Crime Law (UU Tipikor) regime. Using a qualitative normative research method through a comparative regulatory and legal theory approach, this study found a significant conceptual shift from the orientation of punishment that previously positioned corruption as an extraordinary crime to a more general and humanistic perspective. The 2023 Criminal Code prioritizes the principles of proportionality, reintegration, and social recovery over the repressive approach that has characterized the Corruption Law. Although normatively, the Tipikor Law still applies as lex specialis, changes to several articles and recodifications within the Criminal Code indicate signs of normalizing corruption into a general crime regime. Consequently, the potential for a reduced deterrent effect, regulatory loopholes, and obstacles to proving state losses pose serious challenges to eradicating corruption.
