Normative Reconstruction of Substitute PPAT Appointment Time Limits for Legal Certainty in Land Rights Transfer

Abstract

This research examines the normative reconstruction of Article 28 of Government Regulation Number 37 of 1998 concerning the Regulation of the Position of Land Deed Officials, as amended by Government Regulation Number 24 of 2016, particularly regarding time limits for appointing a Substitute PPAT after the death of a PPAT. The study aims to ensure legal certainty and legal protection for parties involved in land rights transfer transactions. This research uses a normative legal method with statutory, conceptual, and case approaches, grounded in legal certainty theory and legal protection theory. The findings show that Article 28 remains normatively incomplete because only the heirs’ obligation to report the PPAT’s death is regulated with a 30-day time limit, while the subsequent stages, namely report forwarding, Substitute PPAT appointment, and protocol handover, have no clear temporal regulation. This creates legal uncertainty and may obstruct the registration of land rights transfers. Therefore, this study proposes a normative reconstruction by setting 14 days for the Head of the Local Land Office to forward the report, 30 days for the Provincial BPN Regional Office to appoint a Substitute PPAT, and 14 days for heirs to hand over the protocol.
