Indonesia is a country governed by the rule of law today The development of the digital world has created a new space where individuals can express their identities more broadly. One example is the identity of the LGBT community, which has sparked a wide range of responses to this phenomenon, leading to changes in Indonesia’s legal system because the expression of identity on social media platforms remains ambiguous, particularly regarding the expression of LGBT identity. While freedom of expression is guaranteed as a fundamental human right, it is also restricted in the name of morality, religious values, and public order; moreover, the legal framework surrounding it remains unclear. In response to this, the author analyzes the ambiguities in legal protection in Indonesia, examining the factors contributing to legal uncertainty and exploring potential solutions that could provide legal clarity in the digital space. The research method used in this study is a normative approach with a qualitative approach to literature review. The results of the study indicate that, to date, there are no specific regulations governing the limits of expression on social media, particularly regarding the expression of LGBT group identity. Therefore, a clear and structured regulatory framework is needed through a regulatory reconstruction mechanism that specifically defines these limits while balancing the values of Pancasila, legal morality, and maintaining legal certainty.
