<![CDATA[Railway level crossing accidents remain a serious issue in the implementation of railway transportation in Indonesia. This study aims to analyze legal liability for third-party losses arising from the Malioboro Express Train (170) accident and to examine the synergy between PT Kereta Api Indonesia (Persero), the government, and the community in promoting public safety at railway level crossings. This research is an empirical legal study with a descriptive nature, employing both statutory and case approaches. Data were collected through field research and literature studies and subsequently analyzed qualitatively based on applicable laws and regulations as well as the facts found in the field. The results indicate that legal liability in railway level crossing accidents is determined based on the elements of fault, causal relationship, and the distribution of authority as stipulated in Articles 1365, 1366, and 1367 of the Indonesian Civil Code, as well as Law Number 23 of 2007 concerning Railways. In the Malioboro Express case, the negligence of the Level Crossing Guard (Penjaga Jalan Lintasan/PJL) was one of the contributing factors to the accident. However, road users also have a legal obligation to give priority to train operations and exercise due care. Furthermore, ensuring public safety requires synergy among PT KAI, the government, and the community. The main obstacles include suboptimal inter-agency coordination, limitations in the construction of grade-separated crossings, and low levels of public compliance.]]>
