Abstract

Abstrak: Rumah sakit merupakan institusi komples yang berpotensi terjadi konflik apabila hubungan antara pemilik, pengelola dan staf medis tidak diatur dengan baik. Hal ini mendasari pembentukan Hospital byLaws. Penelitian ini bertujuan mengetahui pengaturan Hospital byLaws, implementasi Hospital byLaws dalam pelayanan kesehatan bagi dokter subspesialis, dan faktor yang mempengaruhi implementasi Hospital byLaws bagi dokter subspesialis di RSUP Dr. Kariadi. Metode pendekatan yang digunakan adalah yuridis sosiologis dengan spesifikasi penelitian deskriptif analitis. Data yang digunakan berupa dara primer dan sekunder. Data primer berupa kuisioner dan wawancara, data sekunder berupa pengumpulan studi kepustakaan. Hasil penelitian menunjukkan dasar hukum pengaturan HBL RSUP Dr. Kariadi adalah Undang-Undang Dasar 1945, UU No.29 Tahun 2004 tentang Praktik Kedokteran, UU No.36 Tahun 2009 tentang Kesehatan, UU No. 44 Tahun 2009 tentang Rumah Sakit, UU No.17 Tahun 2023 tentang Kesehatan, PP No.28 Tahun 2024 tentang Peraturan Pelaksanaan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Bentuk pengaturan HBL RSUP Dr. Kariadi terdiri dari pengaturan umum dan khusus. Mekanisme implementasi HBL terdiri dari 3 tahapan, yaitu pengorganisasian, interpretasi, dan implikasi. Pihak-pihak yang terlibat dalam implementasi HBL adalah Pemilik, Dewan Pengawas Rumah Sakit, Direksi, Komite Audit, Komite Medik, Komite Etik dan Hukum, Komite Keperawatan, Komite Mutu Rumah Sakit, Komite Koordinasi Pendidikan, Komite Pencegahan dan Pengendalian Infeksi, Komite Etik Penelitian Kesehatan, Satuan Pemeriksaan Internal, dan Kelompok Staf Medis. Faktor yuridis, teknis, dan sosiologis mempengaruhi implementasi HBLKata Kunci: hospital by laws, implementasi, pelayanan kesehatan, dokter subspesialis Abstract: Hospitals are complex institutions, have potential conflict if the relationship between owners, managers and medical staff is not managed well. This underlies the formation of Hospital by Laws. This study aims to determine the arrangements for Hospital byLaws, the implementation of Hospital byLaws in health services for subspecialist doctors, and the factors that influence the implementation of Hospital byLaws for subspecialist doctors at RSUP Dr. Kariadi. The approach method used is sociological juridical with analytical descriptive research specifications. The data used is primary and secondary data. Primary data is questionnaires and interviews, secondary data is literature study collection. The research show that the legal basis for regulating HBL at RSUP Dr. Kariadi is the 1945 Constitution, Law No.29 of 2004 concerning Medical Practice, Law No.36 of 2009 concerning Health, Law no.44 of 2009 concerning Hospitals, Law No.17 of 2023 concerning Health, PP No. 28 of 2024 concerning Implementing Regulations of Law Number 17 of 2023 concerning Health. Form of HBL arrangement at RSUP Dr. Kariadi consists of general and special arrangements. The HBL implementation mechanism consists of 3 stages, organization, interpretation, and implication. The parties involved in implementing HBL are the Owner, Hospital Supervisory Board, Board of Directors, Audit Committee, Medical Committee, Ethics and Legal Committee, Nursing Committee, Hospital Quality Committee, Education Coordination Committee, Infection Prevention and Control Committee, Research Ethics Committee Health, Internal Examination Unit, and Medical Staff Group. Juridical, technical and sociological factors influence the implementation of HBLKeywords: hospital by law, implementation, health services, subspecialist doctors
